75. The Committee expresses its concern that article 4 of the Convention is not fully complied with, since there is no provision in the Finnish legislation prohibiting and punishing organizations which promote and incite racial discrimination.
٥٧ - وتعرب اللجنة عن قلقها إزاء عدم الامتثال بالكامل للمادة ٤ من الاتفاقية، حيث لا يوجد بند في التشريع الفنلندي يحظر ويعاقب المنظمات التي تشجع التمييز العنصري وتحرض عليه.

The Committee urges the State party to consider reviewing this provision and to declare punishable any participation in organizations that promote and incite racial discrimination, in accordance with article 4 (b) of the Convention.
وتحث اللجنة الدولة الطرف على أن تنظر في مراجعة هذا الحكم وأن تجعل أي مشاركة في منظمات تروج التمييز العنصري وتحرض عليه عملاً قابلاً للعقاب، وفقاً لأحكام المادة 4(ب) من الاتفاقية.

The Committee recommends that the State party revise its Criminal Code in order to introduce and implement a specific provision in full compliance with article 4 of the Convention that prohibits dissemination of ideas based on racial superiority or hatred, incitement of racial hatred and discrimination, and prohibition of organizations which promote and incite racial discrimination.
توصي اللجنة الدولة الطرف بأن تراجع قانون العقوبات على نحو تستحدث معه وتنفذ حكماً محدداً، يتوافق كلياً مع المادة 4 من الاتفاقية، ويحظر نشر الأفكار القائمة على التفوق العرقي أو الكراهية العرقية، والتحريض على الكراهية العنصرية والتمييز العنصري، ويحظر المنظمات التي تشجع التمييز العنصري وتحرض عليه.

The Committee reiterates its concern at the absence of a law prohibiting organizations which promote and incite racial discrimination and of a provision in the Penal Code declaring any dissemination of ideas based on racial superiority or hatred punishable by law.

606. Concern is expressed that the State party has not taken all appropriate measures to prohibit organizations which promote and incite racial discrimination, in accordance with article 4 (b) of the Convention.
٦٠٦ - وأُعرب عن القلق ﻷن الدولة الطرف لم تتخذ كل التدابير المناسبة، طبقا للمادة ٤ )ب( من الاتفاقية، لحظر المنظمات التي تروج التمييز العنصري وتحرض عليه.

It is noted that domestic legislation lacks provisions to implement fully article 4 of the Convention, in particular, provision declaring punishable by law all acts of racist violence, the incitement to such acts and the provision of assistance to racist activities, as well as the prohibition of organizations, activities and propaganda which promote and incite racial discrimination.

13. The Committee is concerned that the State's party criminal legislation, particularly the Criminal Code, is not in full compliance with the provisions of article 4 of the Convention, in particular the requirement for criminalizing the dissemination of theories of racial superiority or inferiority and for prohibition of organizations that promote and incite racial discrimination and participation in their activities. (art.4)
13- ويساور اللجنة قلق لأن التشريعات الجنائية في الدولة الطرف، لا سيما القانون الجنائي، لا تتوافق توافقاً تاماً مع أحكام المادة 4 من الاتفاقية، وخصوصاً مع مطلب تجريم بث نظريات التفوق العرقي أو الدونية العرقية وحظر المنظمات التي تروج التمييز العنصري وتحرض عليه وحظر المشاركة في أنشطتها. (المادة 4)

The Committee, while noting the State party's efforts to prohibit, through legislation, all dissemination of ideas based on racial superiority or hatred and incitement to racial hatred, reminds the State party of its obligation under article 4 to prohibit all organizations and activities, including those of the mass media, which promote and incite racial discrimination.
158- وإذ تلاحظ اللجنة الجهود التي تبذلها الدولة الطرف، من خلال التشريع، في حظر أي نشر للأفكار القائمة على التفوق العنصري أو الكراهية أو التحريض على الكراهية العنصرية، فإنها تذكِّر الدولة الطرف بالتزامها بموجب المادة 4 بحظر جميع المنظمات والأنشطة، بما فيها أنشطة وسائط الإعلام، التي تشجع التمييز العنصري وتحرض عليه.

418. Concern was expressed that national legislation did not fully meet the requirements of article 4 of the Convention, as the relevant provisions of the Penal Code, in particular its articles 454 and 455, neither penalized the dissemination of ideas based on racial superiority or hatred, in the broadest sense, nor did they prohibit organizations or propaganda activities that promoted and incited racial discrimination.
٤١٨ - وأعرب اﻷعضاء عن قلقهم لعدم وفاء التشريعات الوطنية تماما بمتطلبات المادة ٤ من الاتفاقية، حيث أن اﻷحكام ذات الصلة من القانون الجنائي، وخاصة المادتان ٤٥٤ و ٤٥٥، لا تعاقب على بث اﻷفكار القائمة على التفوق العنصري أو الكراهية العنصرية، بأوسع معانيهما، ولا تحظر المنظمات أو اﻷنشطة الدعائية التي تشجع التمييز العنصري وتحرض عليه.
