Article 4, paragraph 1, of the Convention refers to the individual criminal liability of a person for complicity or participation in torture.

The Committee is concerned by the fact that the provisions contained in articles 46 and 47 of the Code of Criminal Procedure that refer to the Attorney General's ability to lay charges and initiate legal action do not explicitly criminalize either attempts to commit torture or acts which constitute complicity or participation in torture and therefore are not in full compliance with article 4 of the Convention. In addition, even if not explicitly stated in the Convention, the Committee considers instances that include " instigation, consent or acquiescence " , to be covered by the terms " complicity or participation " , giving rise to individual criminal responsibility under article 4 of all public officials sufficiently involved under article 1.

Similarly, the Convention against Torture and other cruel, inhuman or degrading treatment or punishment not only expressly bans torture, but in its article 4, paragraph 1, it also implicitly prohibits complicity in acts of torture, as it requires each State party to ensure that all acts of torture, including those acts by any person that constitute complicity or participation in torture, are criminal offences under its criminal law.
