70- وكذلك يلاحظ الفريق، فيما يتعلق بالمطالبات المقدمة بشأن عقود مع أطراف كويتية، ما إذا كانت قدرة الأطراف المتعاقدة على استئناف تنفيذ العقد بعد رفع الحظر عن الكويت وما إذا كان استئناف تنفيذ العقد بالفعل، هما من الاعتبارات المتصلة بتحديد حجم الخسائر التي تكبدها صاحب المطالبة عن كسبه الفائت في إطار العقد الذي توقف تنفيذه.

Such losses should be awarded as claims for damages (that is, on the basis of the losses in fact suffered by the claimant), subject to the amounts set out in paragraphs 364(b) and 364(c)(i) and (iii) below.

In this regard, the Panel finds that the evidence is sufficient to demonstrate that the losses incurred by the Claimant to pay for the cost of repairing or replacing work, equipment and materials that were looted, damaged or destroyed during the period of Iraq's invasion and occupation of Kuwait are losses directly linked to Iraq's invasion and occupation of Kuwait.

In respect of the losses incurred by the Claimant to pay for the increased cost of labour and materials and other costs, however, the Panel finds that the evidence is insufficient to establish that they are losses directly linked to Iraq's invasion and occupation of Kuwait.

For the reasons given at paragraph above, the Panel finds that the expenses incurred by the Claimant in purchasing the generators and sirens are, in principle, compensable, subject to an adjustment to the amount claimed for generators to account for their residual value.

The Panel finds that the total cost of the repairs to the barge (i.e. USD 8.3 million) should be reviewed in order to determine the total amount of compensable losses suffered by the claimant in respect of such barge.
