4. The Committee welcomes the new Constitution proclaimed on 26 January 2010, which enshrines the principle of non-discrimination and provides for the direct application of the international human rights treaties ratified by the State party.

The Committee notes with concern that although article 98 of the Constitution provides that treaties ratified by the State party are part of domestic law, the provisions of the International Convention on the Elimination of All Forms of Racial Discrimination have rarely been referred to by national courts.

17. On the question of the violation of national legislation mentioned by the Government, the Working Group recalls that, in conformity with its mandate, it must ensure that national law is consistent with the relevant international provisions set forth in the Universal Declaration of Human Rights or in the relevant international legal instruments to which the State concerned has acceded.
