7. The draft articles provided that an injured State that took countermeasures must fulfil its dispute settlement obligations under Part Three of the draft or any other mandatory dispute settlement procedure in force between the States concerned.

Mr. MIKAELSEN (Denmark), speaking on behalf of the Nordic countries on the question of State responsibility, welcomed the fact that the International Law Commission had approved draft articles 1 to 7, relating to settlement of disputes, given the possible impact of part Three of the draft on the provisions concerning countermeasures.

In that connection, he regretted that the Commission had not yet found a way to avoid the risk of conflict between the procedures set forth in part Three of the draft and those which might be applicable under other instruments in force between States which provided for means of dispute settlement that differed, inter alia, in terms of their hierarchy or the conditions for their implementation.

The shortcomings of the " suspended " formulation of article 12 of Part Two are probably due, in addition to the great difficulty of the subject and the lack of available time, to the fact that that article was prepared prior to the consideration by the Committee of the proposals concerning the post-CMs dispute settlement provisions, namely, the provisions of Part Three of the project.
٧٦ - إن أوجه القصور في الصياغة " المعلقة " للمادة ١٢ من الباب الثاني ترجع على اﻷرجح، باﻹضافة إلى الصعوبة البالغة للموضوع وعدم توافر الوقت الكافي، إلى أن المادة قد أعدت قبل أن تنظر اللجنة في المقترحات المتعلقة بأحكام تسوية المنازعات اللاحقة للتدابير المضادة، ألا وهي أحكام الباب الثالث من المشروع.
