Persons or organizations that have committed or organized or instigated the commission of offences set forth in article 2 of the Convention are held criminally liable in the territory of Azerbaijan.

1. Each State Party shall take such measures as may be necessary to establish its jurisdiction over the offences set forth in article 2 of the present Convention when:

However the Committee is concerned that the crimes enumerated in article 4 of the Convention are not explicitly included in the Extradition Act as extraditable offences.

In contrast, the offences set out in article 5 of the Convention are preventive.

The State party in territory under whose jurisdiction a person alleged to have committed any offence referred to in article 4 is found, shall in the cases contemplated in article 5, if it does not extradite him, submit the case to its competent authorities for the purpose of prosecution.
