prolonged incommunicado detention was one of the preconditions for torture, and constituted a violation of article 7, which was non-derogable. Thus the defence of necessity was totally unacceptable, a doctrine that had been upheld by the Committee, the European Court of Human Rights and the Inter-American Court of Human Rights.

The Special Rapporteur defines prolonged solitary confinement as any period of solitary confinement in excess of 15 days.
ويعرّف المقرر الخاص الحبس الانفرادي المطول بأنه أي فترة من الحبس الانفرادي تجاوز 15 يوما.

The Rules should also prohibit prolonged solitary confinement and frequently renewed measures that amount to prolonged solitary confinement.

Of particular concern to the Special Rapporteur is prolonged solitary confinement, which he defines as any period of solitary confinement in excess of 15 days.
وما يثير قلق المقرر الخاص على وجه الخصوص، هو الحبس الانفرادي المطول الذي يعرّفه المقرر بأنه أية فترة من الحبس الانفرادي تتجاوز 15 يوما.

The Human Rights Committee has noted that prolonged solitary confinement may amount to a violation of the prohibition against torture and ill-treatment in article 7 of the International Covenant on Civil and Political Rights.
