For purposes of this contract, force majeure shall mean an event or condition that the Contractor could not reasonably be expected to prevent or control; provided that the event or condition was not caused by negligence or by a failure to observe good mining industry practice.
وﻷغراض هذا العقد، يعني مصطلح " قوة قاهرة " أي حدث أو ظــــرف لا يتوقع، بشكل معقول، أن يحول المتعاقد دون حدوثه أو أن يسيطر عليه؛ شريطة ألا يكون هذا الحدث أو الظرف ناشئا عن اﻹهمال أو عدم مراعاة الممارسات الحميدة المتبعة في صناعة التعدين.

When the carrier is relieved of part of its liability pursuant to this article, the carrier is liable only for that part of the loss, damage or delay that is attributable to the event or circumstance for which it is liable pursuant to this article.
٦- عندما يعفى الناقل من جزء من مسؤوليته بمقتضى هذه المادة، لا يكون الناقل مسؤولا إلاّ عن ذلك الجزء من الهلاك أو التلف أو التأخر الذي يعزى إلى الحدث أو الظرف الذي هو مسؤول عنه بمقتضى هذه المادة.

3. When the carrier is relieved of part of its liability pursuant to this article, the carrier is liable only for that part of the loss, damage or delay that is attributable to the event or circumstance for which is liable pursuant to this article. "
3- عندما يُعفى الناقل من جزء من مسؤوليته بمقتضى هذه المادة، لا يكون الناقل مسؤولا إلاّ عن ذلك الجزء من الهلاك أو التلف أو التأخر الذي يُعزى إلى الحدث أو الظرف الذي هو مسؤول عنه بمقتضى هذه المادة. "

٦ - عندما يعفى الناقل من جزء من مسؤوليته بمقتضى هذه المادة، لا يكون الناقل مسؤولا إلا عن ذلك الجزء من الهلاك أو التلف أو التأخر الذي يعزى إلى الحدث أو الظرف الذي هو مسؤول عنه بمقتضى هذه المادة.

The carrier is liable for loss of or damage to the goods, as well as for delay in delivery, if the claimant proves that the loss, damage, or delay, or the event or circumstance that caused or contributed to it took place during the period of the carrier's responsibility as defined in chapter 4.
1- يكون الناقل مسؤولا عن هلاك البضاعة أو تلفها، وكذلك عن التأخر في التسليم، إذا أثبت المُطالب أن الهلاك أو التلف أو التأخر، أو الحدث أو الظرف الذي تَسبَّب أو أسهم فيه، قد وقع أثناء مدة التزام الناقل حسبما حُددت في الفصل ٤.

(a) If the claimant proves that the fault of the carrier or of a person referred to in article 19 caused or contributed to the event or circumstance on which the carrier relies; or
(أ) إذا أثبت المطالب أن الخطأ الذي ارتكبه الناقل أو شخص مشار إليه في المادة 19 قد تسبَّب أو أسهم في الحدث أو الظرف الذي يستند إليه الناقل؛ أو
