Firstly, counsel argues that the Preamble to the Optional Protocol as well as its articles 1 and 2 all state that the Protocol gives competence to the Committee to receive and consider communications from individuals subject to the jurisdiction of a State party who claim to be victims of a violation by the State party of any of the rights set forth in the Covenant.
