There are a number of areas, however, where the provisions of the Interim National Constitution are not in coherence with international human rights treaties and norms and this represents a dichotomy in the Constitution, particularly in the area of coherence between customary law enshrined in the Constitution and the duties and obligations of the Government of the Sudan under the relevant international human rights treaties.

16. The Human Rights Committee recommended that the State party deploy all the human and material resources required to hold, within the prescribed time limit, the referendum provided for by the Interim National Constitution.
16 - وأوصت اللجنة بأن توفر الدولة الطرف جميع الموارد البشرية والمادية اللازمة لإجراء الاستفتاء المنصوص عليه في الدستور الوطني الانتقالي في التاريخ المحدد.

The Committee welcomes the adoption of the Interim National Constitution of 9 July 2005, which provides for safeguards of fundamental rights and describes the process for adapting Sudanese legislation to these new provisions.
4- وترحب اللجنة باعتماد الدستور الوطني الانتقالي في 9 تموز/يوليه 2005، الذي ينص على ضمانات للحقوق الأساسية ويشرح عملية تكييف التشريعات السودانية مع هذه الأحكام الجديدة.

The Committee notes with concern that although the Interim National Constitution prohibits the imposition of the death penalty on those under the age of 18, exceptionally in Northern Sudan the death penalty can in fact be imposed on minors.
20- ومع أن الدستور الوطني الانتقالي يحظر فرض عقوبة الإعدام على من هم دون سن الثامنة عشرة، تلاحظ اللجنة بقلق أن عقوبة الإعدام يمكن أن تُوقعّ بصورة استثنائية في شمال السودان بحق القُصّر.

The Committee is concerned that, despite article 27 of the Interim National Constitution of 2005, the rights protected by the Covenant have not yet been recognized and given full effect in the national legal framework.
7- ويساور اللجنة قلق لأنه على الرغم من أحكام المادة 27 من الدستور الوطني الانتقالي لعام 2005، لم يُعترف حتى الآن بالحقوق المحمية بموجب العهد ولم تنفّذ في الإطار القانوني الوطني إنفاذاً كاملاً.

66. Poland appreciated that the Interim National Constitution provided for different commissions to monitor human rights and hoped that they would be established in a speedy manner.

The provision made for the Bill of Rights in the Interim National Constitution has also been mentioned and all rights provided for in the International Covenant on Civil and Political Rights have been incorporated into the Constitution and other laws.
