• the predecessor State was

A successor State, other than a newly independent State, shall also have the capacity provided for in paragraph 1 when making a notification establishing its status as a party or as a contracting State to a treaty which, at the date of the succession of States, was not in force for the predecessor State but in respect of which the predecessor State was a contracting State.
2- يعترف أيضاً للدولة الخلف التي ليست من الدول المستقلة حديثاً بالأهلية المنصوص عليها في الفقرة 1، عندما توجه إشعاراً تثبت به صفتها كدولة متعاقدة أو طرف في معاهدة لم تكن، في تاريخ خلافة الدول، نافذة تجاه الدولة السلف، لكن الدولة السلف كانت دولة متعاقدة فيها.

2. A successor State may not formulate a new reservation at the time of a uniting or separation of States unless it makes a notification whereby it establishes its status as a party or as a contracting State to a treaty which, at the date of the succession of States, was not in force for the predecessor State but to which the predecessor State was a contracting State.
2 - لا يجـــوز للدولة الخلــف أن تبدي تحفظا جديدا لدى اتحاد دول أو انفصالها إلا عندما توجه إشعارا تثبت به صفتها كدولة متعاقدة أو طرف في معاهدة لم تكن، في تاريخ خلافة الدول، نافذة تجاه الدولة السلف، لكن الدولة السلف كانت دولة متعاقدة فيها.
