1. A reservation established with regard to another party excludes or modifies for the reserving State or international organization in its relations with that other party the legal effect of the provisions of the treaty to which the reservation relates or of the treaty as a whole with respect to certain specific aspects, to the extent of the reservation.
1 - إن إنشاء التحفظ إزاء طرف آخر يستبعد أو يعدل بالنسبة إلى الدولة المتحفظة أو المنظمة الدولية المتحفظة، في علاقاتها مع ذلك الطرف الآخر، الأثر القانوني لأحكام المعاهدة التي يتعلق بها التحفظ أو الأثر القانوني للمعاهدة ككل فيما يتعلق ببعض الجوانب المحددة، وبحدود ذلك التحفظ.

While such a link was easy to identify, it should not replace the claims of either the custodial State or the State on whose territory the crime was committed.

4 - إذا رأت هيئة رصد المعاهدة أن التحفظ غير صحيح وكانت الدولة المتحفظة أو المنظمة الدولية المتحفظة تعتزم عدم الالتزام بالمعاهدة بدون الاستفادة من التحفظ، ينبغي لها أن تعرب عن هذه النية في غضون الاثني عشر شهرا التالية لتاريخ إعلان هيئة رصد المعاهدة رأيها.

4. The phrase " in itself " nonetheless leaves open the possibility that the responsibility of the reserving State or international organization might be engaged as a result of the effects produced by such a reservation.
