" With regard to the implementation of article III, paragraph 2 of the Treaty, the Conference notes that a number of States suppliers of material or equipment have adopted certain minimum, standard requirements for IAEA safeguards in connection with their exports of certain such items to non-nuclear-weapon States not parties to the Treaty (IAEA document INFCIRC/209 and addenda).

E. Nuclear supplying States parties are encouraged to exercise their sovereign right -- in accordance with international law and their national legislation -- to incorporate dismantling and/or return clauses or fall-back safeguards in the event of withdrawal, as appropriate, in contracts or any other arrangement concluded with other States parties.
