The treaty should not prejudice the right of States to self-defence under Article 51 of the Charter of the United Nations, which also implies that States have the legitimate right to acquire means for self-defence, including through the development, manufacture, acquisition and import of arms required to ensure their national defence.

8. Recognizing the right of States to self-defence and participation in peacebuilding and peacekeeping operations, minimal international requirements for control of the arms trade need to be laid down in the treaty and made legally binding.

For those reasons Costa Rica cannot endorse a deferral of action on draft resolution A/C.1/51/L.46 based on the argument that a paragraph must be included on the right of States to self-defence.

Finally, with respect to the ongoing discussions on a future arms trade treaty, my delegation wishes to underline that an international legally binding instrument must take into consideration the concerns of all States and should be consistent with the United Nations Charter, in particular Article 51, which enshrines the right of States to self-defence.
أخيراً، فيما يتعلق بالمناقشات الجارية بشأن إبرام معاهدة تجارة الأسلحة في المستقبل، يود وفد بلدي أن يؤكد أنه يجب على الصك الدولي الملزم قانوناً أن يأخذ شواغل جميع الدول بعين الاعتبار، وينبغي أن يكون متسقاً مع ميثاق الأمم المتحدة، ولا سيما المادة 51، التي تنص على حق الدول في الدفاع عن النفس.

13. The effort to combat the illegal arms trade raised many complex issues related to the distinction between the licit and illicit trade in weapons, the need to respect national sovereignty, the responsibility of States to provide security and the right of States to self-defence.
13 - ومضت إلى القول إن الجهود الرامية إلى مكافحة الاتجار غير المشروع بالأسلحة تثير مسائل معقدة كثيرا تتصل بالتمييز بين الاتجار المشروع بالأسلحة والاتجار غير المشروع بها، والحاجة إلى احترام السيادة القومية، ومسؤولية الدول عن توفير الأمن، وحق الدول في الدفاع عن النفس.

We share, too, the deep reservations about a narrow statement in the opinion that could read as though it questions the right of States to self-defence against terrorism, despite all the evidence in law, Security Council resolutions and State practice to the contrary.

أود أن أعرب عن رأي وفد بلدي فيما يتعلق بالمفاوضات الجارية بشأن التوصل إلى معاهدة لتجارة الأسلحة في المستقبل. وأؤكد في هذا السياق أنه ينبغي أن يتسم ذلك الصك الدولي الملزم قانوناً بالتوازن وأن يأخذ شواغل جميع الدول في الاعتبار وأن يكون متماشيا مع ميثاق الأمم المتحدة، وخصوصاً مع المادة 51 التي تكرّس حق الدول في الدفاع عن النفس.

It is vitally important that any such instrument be consistent with the right of self-defence of States and their right to protect their legitimate foreign policy and national security interests.
ومن الأهمية بمكان أن يكون أي صك من هذا القبيل متسقا مع حق الدول في الدفاع عن النفس وحقها في حماية سياساتها الخارجية المشروعة ومصالح الأمن القومي لديها.
