The Security Council has not defined “debts and obligations” nor has it provided guidelines on when a debt arises.
47- ولم يعرّف مجلس الأمن عبارة " الديون والالتزامات " ولا هو وفّر مبادئ توجيهية بشأن الوقت الذي ينشأ عنده دَيْن ما.

These unusually long payment terms as described were a consequence of the magnitude of the old debt; but for those unusually long payment terms, the debts and obligations involved would be a part of the old debt.
إن آجال الدفع هذه، الطويلة إلى حد غير عادي، حسبما وصفت، كانت نتيجة لحجم الديون القديمة؛ إلا أنه، فيما يتعلق بآجال الدفع الطويلة إلى حد غير عادي، تكون الديون والالتزامات موضوع البحث جزءا من الديون القديمة.

Accordingly, the Panel finds that the terms “debts and obligations of Iraq arising prior to 2 August 1990 " means a debt or an obligation that is based on work performed or services rendered prior to 2 May 1990.Further, the Panel notes that the debts and obligations that are affected by the “arising prior to” clause are debts and obligations of Iraq.

The Panel finds, therefore, that there is no basis to distinguish between Iraqi private and public parties for the purposes of the Commission’s jurisdiction over debts and obligations arising prior to 2 August 1990.

The Government of Iraq has learned that the Governing Council of the United Nations Compensation Commission at Geneva was on the point of considering the report submitted to it with a view to determining whether Iraq should pay compensation in respect of its debts and obligations arising prior to 2 August 1990, and that the report was in the form of a lengthy legal study.
علمت حكومة العراق أن مجلس إدارة لجنة اﻷمم المتحدة للتعويضات في جنيف بصدد دراسة التقرير المقدم اليه لتحديد ما إذا كان على العراق دفع التعويضات عن الديون والالتزامات المترتبة عليه قبل ٢ آب/أغسطس ١٩٩٨ وأن هذا التقرير قدم على شكل دراسة قانونية موسعة.

Therefore, for the purposes of the " arising prior to " clause, debts and obligations subject to such rescheduling or long payment terms form part of Iraq's old debt and, accordingly, have been excluded from the jurisdiction of the Commission.
ولهذا فإن الديون والالتزامات التي أُعيدت جدولتها أو آجال الدفع الطويلة تشكل، لأغراض شرط " الناشئة قبل " ، جزءا من ديون العراق القديمة، وتستبعد لذلك من نطاق اختصاص اللجنة(23).

As described at paragraph , the rescheduling of debts and obligations or the conclusion of unusually long payment terms should not serve to mask Iraq's old debt, and claims where such arrangements exist are excluded from the jurisdiction of the Commission under the " arising prior to " clause.
93- وكما جاء في الفقرة 51 أعلاه، فإن إعادة جدولة الديون والالتزامات والاتفاق على آجال دفع أطول من المعتاد لا ينبغي أن يحجب ديون العراق القديمة، ولهذا فإن المطالبات التي تتضمن مثل هذه الترتيبات تستبعد من نطاق اختصاص اللجنة بموجب شرط " الناشئة قبل " (50).

Therefore, for the purposes of the " arising prior to " clause, debts and obligations subject to such rescheduling or long payment terms form part of Iraq's old debt and are excluded from the jurisdiction of the Commission. /

For purposes of review of claims for receivables owed by an Iraqi party, such claims include claims for debts and obligations owed both by the Iraqi government and Iraqi private parties operating or residing in Iraq.
(أ) لأغراض استعراض مطالبات التعويض عن المبالغ المستحقة على طرف عراقي، تشمل هذه المطالبات مطالبات التعويض عن الديون والالتزامات المستحقة على حكومة العراق وعلى الأطراف الخاصة العراقية العاملة أو المقيمة في العراق.

(أ) القصد من عبارة " دون المساس بديون والتزامات العراق الناشئة قبل 2 آب/أغسطس 1990 والتي سيجري تناولها عن طريق الآليات العادية " هو أن يكون لها أثر استبعادي يقيد نطاق اختصاص اللجنة بمعنى أن تكون هذه الديون والالتزامات غير قابلة للتعويض من جانبها؛

The term “debts and obligations” has, however, been defined by the “E2” Panel, as “obligations to make future payments, in cash or in kind, in specified or determinable amounts and with fixed or determinable rates of interest (which may be zero)”.
48- بيد أن عبارة " الديون والالتزامات " قد عرّفها الفريق " هاء - 2 " بأنها " التزامات لتسديد دفعات مستقبلاً نقداً أو عيناً، بمبالغ محددة أو يمكن تحديدها وبأسعار فائدة ثابتة أو يمكن تحديدها قد تكون صفراً " (9).

The term “debts and obligations” has, however, been defined by the “E2 Panel”, as “obligations to make future payments, in cash or in kind, in specified or determinable amounts and with fixed or determinable rates of interest (which may be zero)”. “E2 " report, para. 65.
68- بيد أن عبارة " الديون والالتزامات " قد عرّفها الفريق " هاء - 2 " بأنها " التزامات لتسديد دفعات مستقبلاً نقداً أو عيناً، بمبالغ محددة أو يمكن تحديدها وبأسعار فائدة ثابتة أو يمكن تحديدها (قد تكون صفراً) " (10). ويستنتج الفريق أن هذا التعريف ينقل بدقة معنى العبارة المذكورة.
