58. The importance of bilateral and international cooperation in discouraging the demand that fosters all forms of exploitation of persons, especially women and children, that leads to trafficking has been noted in article 9 of the Trafficking Protocol.

Article 9 (5) of the Protocol to Prevent, Suppress and Punish Trafficking in Persons, especially Women and Children [The Trafficking in Persons Protocol] calls upon State Parties to discourage the demand that fosters all forms of exploitation of persons and leads to human trafficking.

It briefly outlines the activities of the Special Rapporteur on trafficking in persons, especially women and children, from 1 August 2012 to 28 February 2013, and contains a thematic analysis of the integration of a human rights-based approach in measures to discourage demand that fosters all forms of exploitation of persons, especially women and children, and which leads to human trafficking.

In its article 18, European Union directive 2011/36 on preventing and combating trafficking in human beings and protecting its victims similarly contains a provision to discourage and reduce the demand that fosters all forms of exploitation related to trafficking in human beings and requires Member States to consider taking measures to establish as a criminal offence knowingly using the services of victims of trafficking in persons.

Paragraph 25 of the preamble to the Directive further requires that Member States should establish and/or strengthen policies to prevent trafficking in human beings, including measures to discourage and reduce the demand that fosters all forms of exploitation by means of research, including research into new forms of trafficking in human beings, information, awareness-raising and education.

Under the terms of article 9 of the Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, supplementing the United Nations Convention against Transnational Organized Crime, States parties are required to " adopt or strengthen legislative or other measures ... to discourage the demand that fosters all forms of exploitation of persons, especially women and children, that leads to trafficking " .

At its third session, held in October 2006, the Conference of the Parties to the Organized Crime Convention urged States parties to take or strengthen measures to discourage the demand that fosters all forms of exploitation of persons, especially women and children, that lead to trafficking (see CTOC/COP/2006/14, decision 3/3).

"
