On 13 September 2011, the State party informed the Committee that its authorities have decided to extradite the complainant to Algeria.
في 13 أيلول/سبتمبر 2011، أبلغت الدولة الطرف اللجنة بأن سلطاتها قررت تسليم صاحب الشكوى إلى الجزائر.

At the same time, the Committee, acting in accordance with rule 108, paragraph 9, of its rules of procedure, requested the State party not to deport the complainant to Algeria while his complaint was being considered.

7.8 In the present case, according to the Committee, the essential purpose of the appeal was to prevent the deportation of the complainant to Algeria.

7.5 The Committee also noted that on 30 September 2002, after communicating its comments on the admissibility of the complaint, the State party had enforced the order for the deportation of the complainant to Algeria.

1.2 On 31 October 2012, the Committee, through its Special Rapporteur on new communications and interim measures, asked the State party not to extradite the complainant to Algeria while his complaint was under consideration by the Committee.

14. The Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, considers that the deportation of the complainant to Algeria constituted a breach of articles 3 and 22 of the Convention.
14- وترى لجنة مناهضة التعذيب، وهي تتصرف بموجب الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، أن ترحيل صاحب الشكوى إلى الجزائر يشكل خرقاً لأحكام المادتين 3 و22 من الاتفاقية.

1.2 On 26 January 2000, the Committee forwarded the complaint to the State party for comments and requested it, under rule 108, paragraph 1, of the Committee's rules of procedure, not to return the complainant to Algeria while his complaint was under consideration by the Committee.

On 24 February 2012, the State party informed the Committee that by decision of the Government of Morocco, Decree No. 2-10-001 of 25 March 2010 to extradite the complainant to Algeria had been annulled (Decree No. 12-12-13 of January 2012), and that Mr. Ktiti had been released on 2 February 2012.

34. On 17 May 2005, in Mafhoud Brada v. France, the Committee against Torture, " ... acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, considers that the deportation of the complainant to Algeria constituted a breach of articles 3 and 22 of the Convention. " 30
34 - وفي 17 أيار/مايو 2005، اعتبرت لجنة مناهضة التعذيب، في قضية مفهود برادا ضد فرنسا " ... عملا بالفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، أن ترحيل مقدم الشكوى إلى الجزائر شكلت انتهاكا للمادتين 3 و 22 من الاتفاقية " (30).

7.9 To this extent, the Committee was of the view that returning the complainant to Algeria despite the request made to the State party under rule 108 of the rules of procedure, and before the admissibility of the complaint had been considered, made the remedies available to the complainant in France pointless, and the complaint was accordingly admissible under article 22, paragraph 5, of the Convention.
7-9 ولذلك ترى اللجنة أن إعادة صاحب الشكوى إلى الجزائر رغم الطلب الذي قدمته إلى الدولة الطرف بموجب المادة 108 من نظامها الداخلي، وقبل البدء في النظر في مقبولية الشكوى، تجعل سبل الانتصاف المتاحة لصاحب الشكوى في فرنسا عقيمة، ولذلك ترى اللجنة أن الشكوى مقبولة بموجب أحكام الفقرة 5 من المادة 22 من الاتفاقية.
