If the requested Party cannot comply with the requirement of confidentiality, it shall promptly inform the requesting Party.
وإذا تعذر على الطرف متلقي الطلب التقيد بشرط السرية فعليه أن يبادر بلا إبطاء إلى إبلاغ الطرف الطالب بذلك .

In such a case, the requested Party shall consult with the requesting Party to determine if the assistance can still be given subject to such terms and conditions as the requested Party deems necessary.
وفي هذه الحالة يتعين على الطرف متلقي الطلب أن يتشاور مع الطرف الطالب لتقرير ما إذا كان يمكن تقديم المساعدة حسب ما يراه الطرف متلقي الطلب ضروريا من شروط وأوضاع .

If the requested Party cannot comply with the requirement of confidentiality, it shall promptly inform the requesting Party.
وإذا تعذر على الطرف متلقي الطلب التقيد بشرط السرية ، وجب عليه أن يبلغ الطرف الطالب بذلك على الفور .

(ii) Submit to its competent authorities, with a view to giving effect to it to the extent requested, an order of confiscation issued by the requesting Party in accordance with paragraph 1 of this article, insofar as it relates to proceeds of crime, property, instrumentalities or any other things referred to in paragraph 1 situated in the territory of the requested Party;
`٢` تقدم إلى سلطاتها المختصة أمر مصادرة صادر من الطرف الطالب وفقا للفقرة ١ من هذه المادة ؛ بهدف تنفيذه بالقدر المطلوب ، وبقدر ما يتعلق بعائدات الجريمة أو الممتلكات أو الوسائط أو أي أشياء أخرى من المشار إليها في الفقرة ١ والواقعة في إقليم الطرف متلقي الطلب ؛

5. Extradition shall be subject to the conditions provided for by the law of the requested State Party or by applicable extradition treaties, including the grounds upon which the requested Party may refuse extradition.
٥- يخضع تسليم المجرمين، بما في ذلك اﻷسباب التي يجوز أن يستند إليها الطرف متلقي الطلب في رفض التسليم، للشروط التي ينص عليها قانون الدولة الطرف متلقية الطلب أو معاهدات تسليم المجرمين الواجبة التطبيق.

12. The requesting State Party may require that the requested Party keep confidential the fact and substance of the request, except to the extent necessary to execute the request.
٢١- يجوز للدولة الطرف الطالبة أن تشترط على الطرف متلقي الطلب أن يحافظ على سرية الطلب ومضمونه، باستثناء القدر اللازم لتنفيذه.

15. The requesting State Party may require that the requested Party keep confidential the fact and substance of the request, except to the extent necessary to execute the request.

If the requested Party cannot comply with the requirement of confidentiality, it shall promptly inform the requesting Party (1988 Convention, article 7, paragraph 14).
وإذا تعذر على الطرف متلقي الطلب التقيد بشرط السرية فعليه أن يبادر بلا إبطاء إلى إبلاغ الطرف الطالب بذلك )الفقرة ٤١ من المادة ٧ من اتفاقية ٨٨٩١(.

In such a case, the requested Party shall consult with the requesting Party to determine if the assistance can still be given subject to such terms and conditions as the requested Party deems necessary (1988 Convention, article 7, paragraph 17).
وفي هذه الحالة يتعين على الطرف متلقي الطلب أن يتشاور مع الطرف الطالب لتقرير ما إذا كان يمكن تقديم المساعدة حسب ما يراه الطرف متلقي الطلب ضروريا من شروط وأوضاع )الفقرة ٧١ من المادة ٧ من اتفاقية ٨٨٩١(.
