The author submits that he has a family life in the State party and that the refusal to grant him residence constitutes a disproportionate limitation of his and his father's family life and a violation of articles 23 and 24 of the Covenant.

Lastly, the Committee recommends that, in the light of article 44, paragraph 6, of the Convention, the initial report and written replies presented by the State party be made widely available to the public at large and that consideration be given to publishing the report, along with the relevant summary records and the present concluding observations of the Committee.

12. The Committee notes with concern the continuing wage difference between men and women in the State party and the fact that the income of female heads of household is 20 per cent lower than that of male heads of household (arts. 3 and 7 (a)).

The Committee notes that illiteracy rates remain a problem in the State party and that inequalities persist in literacy levels between the white and black populations.

177. The Committee notes with deep concern that internal hostilities in which civilians, including children, are killed persist in the State party and that many children are not able to fully enjoy their right to life, survival and development owing to the hostilities and their effects.
177- تلاحظ اللجنة ببالغ القلق استمرار أعمال الامتثال المحلية أن البلد التي ذهب ضحيتها المدنيون بمن فيهم الأطفال، في الدولة الطرف وأن عدم قدرة العديد من الأطفال التمتع تمتعاً تاماً بحقهم في الحياة والبقاء والنمو نظراً لأعمال الاقتتال وما تخلفه من آثار.

417. The Committee notes with concern that the Covenant is not directly applicable in the State party and that the rights recognized in the Covenant cannot directly be invoked by individuals in courts, as reflected by the absence of court decisions containing references to the Covenant.
417- تلاحظ اللجنة مع القلق أن العهد لا يطبق تطبيقاً مباشراً في الدولة الطرف وأن الأفراد لا يمكنهم الاحتجاج بالحقوق المنصوص عليها في العهد بصورة مباشرة أمام المحاكم حسبما يتبين من عدم وجود أي قرارات صادرة عن المحاكم تتضمن إشارات إلى العهد.

13. The Committee notes with concern that Arabic is the only official language in the State party and that the Amazigh population continues to be denied the use of their language at the official level.
13- وتلاحظ اللجنة بقلق أن اللغة العربية هي اللغة الرسمية الوحيدة في الدولة الطرف وأن الشعب الأمازيغي لا يزال محروماً من استخدام لغته على الصعيد الرسمي.

165. Again in the same case, the authors claimed that they had been denied the right to comment on a last submission made by the other party and that this also constituted a breach of article 14, paragraph 1 of the Covenant.
165- وأيضاً في القضية نفسها، ادعى صاحبا البلاغ أنه رُفض منحهما الحق في التعليق على الرسالة الأخيرة التي أرسلتها الدولة الطرف وأن هذه المسألة شكلت كذلك انتهاكا للفقرة 1 من المادة 14 من العهد.

Furthermore, the Committee welcomes the development of legislation in Scotland to reflect article 12 of the Convention, but notes that similar legislation is required throughout the State party and that guidelines are insufficient measures to implement article 12.

265. While appreciating that some measures have been taken to give children's views more weight in schools, communities, and in decision-making procedures, the Committee is concerned that it is still generally difficult for children to be heard in the State party, and that their right to be heard in proceedings affecting them may be limited.
265- مع أن اللجنة تقدر أن بعض التدابير قد اتخذت لإعطاء آراء الأطفال وزناً أكبر في المدارس والمجتمعات المحلية وفي إجراءات صنع القرار، فإنها تشعر بالقلق لأنه لا يزال من الصعب عموماً الاستماع إلى الأطفال في الدولة الطرف وأن حقهم في أن يُسمع إليهم في الإجراءات التي تعنيهم ربما كان محدوداً.

The Committee notes the absence of court cases regarding racial discrimination in the State party and that only two complaints of racial discrimination were brought before the Commission on Human Rights in 2000 and 2001.
296- وتلاحظ اللجنة عدم وجود دعاوى قضائية تتعلق بالتمييز العنصري في الدولة الطرف وأن شكويَيْن فقط تتعلقان بالتمييز العنصري قُدِّمتا إلى لجنة حقوق الإنسان في عامي 2000 و2001.

8. The Committee has been informed that violence against women remains prevalent in the State party and that victims face serious challenges in relation to gaining access to justice and effective remedies.
8 - أُبلغت اللجنة أن العنف ضد المرأة مازال متفشياً في الدولة الطرف وأن الضحايا يواجهن تحديات خطيرة فيما يتعلق بالوصول إلى العدالة وإلى سبل الانتصاف الفعالة.

The Committee also welcomes information that undocumented children have access to education in the State party and that citizenship and civic education, including human rights, forms part of the national curriculum at all school levels.
وترحب اللجنة أيضاً بالمعلومات التي تفيد بأن الأطفال غير الحائزين لوثائق ثبوتية يستفيدون من التعليم في الدولة الطرف وأن المواطنة والتربية المدنية، بما في ذلك حقوق الإنسان، تشكل جزءاً من المنهج الدراسي الوطني على جميع المستويات الدراسية.

1431. Finally, the Committee recommends that, in the light of article 44, paragraph 6, of the Convention, the initial report and written replies submitted by the State party be made widely available to the public at large and that the publication of the report be considered, along with the relevant summary records and the concluding observations adopted thereon by the Committee.
1431- وأخيراً توصي اللجنة، على ضوء الفقرة 6 من المادة 44 من الاتفاقية بأن يتاح للجمهور التقرير الأوَّلي والردود الخطية التي تقدمها الدولة الطرف وأن يتم التفكير في نشر التقرير مشفوعاً بالمحاضر الموجزة ذات الصلة بالموضوع والملاحظات الختامية التي تعتمدها اللجنة في هذا الصدد.

349. The Committee notes with concern the distinction made between " legitimate " and " illegitimate " children in the Civil Code of the State party and the fact that children born out of wedlock do not have the same rights as children born in wedlock.
349- وتلاحظ اللجنة بقلق التمييز بين الأطفال " الشرعيين " و " غير الشرعيين " في القانون المدني للدولة الطرف وأن الأطفال المولودين خارج رباط الزوجية لا يتمتعون بنفس الحقوق التي يتمتع بها الأطفال المولودون ضمن إطار الزواج.

Rule 51 of the rules of procedure provides that representatives of a State party shall be present at meetings of the Committee when the report of the State is being examined and shall participate in discussions and answer questions concerning the reports.
وتنص المادة 51 من النظام الداخلي على أن يحضر ممثلو الدولة الطرف جلسات اللجنة التي يجري فيها بحث تقرير تلك الدولة الطرف وأن يشتركوا في المناقشات وأن يجيبوا على الأسئلة المتعلقة بالتقارير المعنية.
