26. In its resolution 1/4, the Conference of States Parties to the Convention set up the Open-ended Intergovernmental Working Group on Asset Recovery to assist the Conference in the implementation of its mandate relating to the return of the proceeds of corruption.

In its resolution 54/128 of 17 December 1999, entitled “Action against corruption”, the General Assembly stressed the need for a global strategy against corruption, and invited Member States to examine the adequacy of their domestic legal regimes in terms of preventing and controlling corruption and providing for forfeiture of the proceeds of corruption.
٢- وفي القرار ٤٥/٨٢١ المؤرخ ٧١ كانون اﻷول/ديسمبر ٩٩٩١ الذي اتخذته الجمعية العامة بعنوان " تدابير مكافحة الفساد " ، أكدت الجمعية ضرورة وجود استراتيجية عالمية لمكافحة الفساد، ودعت الدول اﻷعضاء الى دراسة مدى كفاية أن تدرس مدى ملاءمة نظمها القانونية الداخلية فيما يتعلق بدرء الفساد والنص على مصادرة العائدات المتأتية من الفساد.

Strong political commitment for asset recovery has been expressed in the Declaration of Commitment of Port of Spain, adopted at the Fifth Summit of the Americas on 19 April 2009, in which 34 Governments reiterated their commitment " to deny safe haven to corrupt officials, those who corrupt them and their assets, and to cooperate in their extradition as well as in the recovery and return of the proceeds of corruption to their legitimate owners. "
27- وقد أُبدي التزام سياسي قوي باسترداد الموجودات في إعلان التزام بورت أوف سبين، الذي اعتُمد في مؤتمر القمة الخامس للقارة الأمريكية في 19 نيسان/أبريل 2009، حيث جددت حكومات 34 دولة التزامها بـ " حرمان الموظفين الفاسدين والمتسببين في إفسادهم وموجوداتهم من أي ملاذ آمن والتعاون على تسليمهم وكذلك استرداد العائدات المتأتية من الفساد وإعادتها إلى أصحابها الشرعيين.
