٣-٣ بالرغم من انتهاء هذا العقد وفقا للبند ٣-١ منه، فإذا طلب المتعاقد عقد استكشاف، قبل تسعين يوما على اﻷقل من تاريخ انتهاء العقد، فإن حقوق المتعاقد والتزاماته بموجب هذا العقد تستمر إلى أن ينظر في الطلب ويتم إصدار عقد الاستكشاف أو رفضه.

Section 1031 of the 1998 German Arbitration Law deems compliance with the writing requirement “if the arbitration agreement is contained in a document, transmitted from one party to the other party or by a third party to both parties and—if no objection was raised in good time—the contents of such document are considered to be part of the contract in accordance with common usage”.
والبند ١٣٠١ من قانون التحكيم اﻷلماني لسنة ٨٩٩١ يعتبر الامتثال لشرط الكتابة " اذا كان اتفاق التحكيم واردا في وثيقة ، ومرسلا من طرف الى الطرف اﻵخر ، أو من قبل طرف ثالث الى الطرفين- واذا لم يكن هناك اعتراض في الوقت المناسب - فان محتويات هذه الوثيقة تعتبر جزءا من العقد وفقا للعرف السائد " .

3-3 بالرغم من انتهاء هذا العقد وفقا للبند 3-1 منه، فإذا طلب المتعاقد عقد استكشاف، قبل 90 يوما على الأقل من تاريخ انتهاء العقد، فإن حقوق المتعاقد والتزاماته بموجب هذا العقد تستمر إلى أن ينظر في الطلب ويتم إصدار عقد الاستكشاف أو رفضه.

On the merits of the seller's claim, the Court found that the buyer had fundamentally breached the contract by refusing to take delivery of the goods and that the seller was entitled to avoid the contract pursuant to articles 61 (1) and 64 (1) (a) CISG.

(b) The contract is sooner terminated, provided that the term of the contract may be extended in accordance with sections 3.2 and 17.2 hereof.
