The representative stressed that, according to the Libyan Penal Code, preventive measures could be imposed only within the limits specified by the law.
وأكد الممثل على أنه طبقا لقانون العقوبات الليبي لا يجوز فرض التدابير الاحتياطية إلا في الحدود التي يعينها القانون.

They noted that economic crimes were punishable by death under the Libyan Penal Code and they observed that such a penalty seemed to be out of proportion to the nature of the crime.

وقانون العقوبات الليبي وتعديلاته المختلفة لا يتضمن أية أحكام تشكل تمييزا ضد المرأة، بل أن القانون أفرد للمرأة، وخاصة المرأة الحامل، معاملة خاصة فيما يتعلق بإيوائها في السجن ومعاملتها فيه.

The collection and provision of funds for the purpose of carrying out terrorist acts is criminalized under the Libyan Penal Code, irrespective of whether the terrorist act takes place, and whether it occurs inside the country or abroad.
الــرد: إن جمع الأموال وتوفيرها بقصد القيام بأعمال إرهابية جرم في قانون العقوبات الليبي بغض النظر عن وقوع الفعل الإرهابي من عدمه، وسواء تم داخل البلاد أو خارجها.

25. The Libyan Criminal Code guarantees respect for the human person and prohibits all forms of physical and mental torture, without distinguishing between males and females.
25- ويكفل قانون العقوبات الليبي احترام آدمية الإنسان وحظر كافة صور الاعتداء المادي أو المعنوي دون تمييز بين ذكر أو أنثى.

The Libyan Penal Code stipulates as follows:
309- ينص قانون العقوبات الليبي على ما يلي:

44. Chapter IV, section 2, of the Libyan Penal Code deals with offences against personal freedom.
44- ويعالج الفصل الثاني من الباب الرابع من قانون العقوبات الليبي الجرائم ضد الحرية الشخصية.

11. Under the Libyan Penal Code, the following offences are punishable by death:
١١- إن الجرائم التي يعاقب عليها قانون العقوبات الليبي باﻹعدام هي كاﻵتي:

The Libyan Penal Code had criminalized trafficking in or sale of women, and other legislative measures had been taken against traditional practices that discriminated against women.
ومضت تقول إن قانون العقوبات الليبي يجرم الاتجار بالنساء أو بيعهن، كما اتخذت إجراءات تشريعية أخرى ضد الأساليب التقليدية التي تقر التمييز ضد المرأة.

This article of the Libyan Penal Code goes even further by prohibiting the placement of any person in a state similar to slavery, other forms of which have been engendered by the realities of contemporary life in the fields of narcotic drugs and prostitution in which, in some cases, the means of coercion used even include the placement of persons in a state similar to slavery.
ويذهب النص في قانون العقوبات الليبي إلى تحريم وضع إنسان ما في حالة تشبه العبودية، وذلك ما يمكن أن يشمل صوراً أخرى يفرزها واقع الحياة المعاصرة، في مجال المخدرات والدعارة حيث تستخدم وسائل الاكراه التي تصل إلى حد وضع اﻹنسان في حالة تشبه العبودية.

The Libyan Penal Code prohibits offences, including sexual offences, against young persons under 18 years of age. Sex may only take place within the framework of the laws regulating marriage.
25- يمنع قانون العقوبات الليبي الجرائم الواقعة على الأحداث الذين تقل سنهم عن 18 سنة بما في ذلك الجرائم الجنسية، ولا يجوز مزاولة الجنس إلا في إطار القوانين المنظمة للزواج.

The Libyan Penal code further includes laws for penalties against crimes perpetrated against the family, such as the failure to meet family obligations, the abuse of corporal punishment and the abuse of children or of any members of the family, as well as penalties against the perpetrators of crimes against the moral values of families and crimes that threaten the existence of the family.
كما أن قانون العقوبات الليبي يتضمن فصولا عن العقوبات التي تفرض على مرتكبي الجرائم ضد اﻷسرة، مثل التقصير في القيام بالواجبات العائلية، أو سوء استعمال وسائل اﻹصلاح والتربية، وإساءة معاملة أفراد اﻷسرة واﻷطفال، كما ينص على عقوبات ضد مرتكبي جرائم ضد أخلاق اﻷسرة والجرائم التي تهدد كيانها.

18. The Libyan Penal Code of 1956.
٨١ - قانون العقوبات الليبي لسنة ٦٥٩١.

96.14. Abolish legal provisions that criminalize the dissemination of information considered to tarnish the Libyan Arab Jamahiriya's reputation abroad, including article 178 of the Libyan Penal Code (United States);
96-14- أن تلغي أحكام القانون التي تجرم ترويج معلومات تُعتبر ملطِّخة لسمعة الجماهيرية العربية الليبية في الخارج، بما في ذلك المادة 178 من قانون العقوبات الليبي (الولايات المتحدة)؛

186. With regard to article 4 of the Convention, clarification was sought about the types of penalties provided by the Libyan Penal Code for persons guilty of torture and the sentences handed down by the criminal courts in cases of acts of torture, particularly when those acts had resulted in the death of the victim.
١٨٦ - وفيما يتعلق بالمادة ٤ من الاتفاقية، فقد طلب ايضاح أنواع العقوبات التي ينص عليها قانون العقوبات الليبي بالنسبة لمرتكبي جريمة التعذيب وعن العقوبات التي تحكم بها المحاكم الجنائية في قضايا التعذيب، وخاصة عندما تؤدي هذه اﻷفعال الى وفاة الضحية.

197. In connection with article 3 of the Convention, the representative stated that under the Libyan Penal Code the extradition of a person charged with a criminal offence which was politically motivated was prohibited.
٧٩١ - وفيما يتعلق بالمادة ٣ من الاتفاقية، ذكر الممثل أن قانون العقوبات الليبي يحظر تسليم اﻷشخاص المتهمين بجرائم جنائية ذات دوافع سياسية، كما لا يجيز تسليم اللاجئين السياسيين أو اﻷشخاص الذين يحتمل تعذيبهم.

21. Slavery and the slave trade are prohibited by the Libyan Penal Code, article 425 of which stipulates that " anyone who enslaves a person or places him in a situation similar to slavery shall be punished by a term of 15 years' imprisonment. "
21- وحرم قانون العقوبات الليبي الاستعباد والتعامل بالرقيق والاتجار به حيث نصت المادة 425 من هذا القانون على ما يلي: " كل من استعبد شخصاً أو وضعه في حالة شبه عبودية يعاقب بالسجن من خمس سنوات إلى خمس عشرة سنة " .

The age of majority is 18 years. At that age, children become responsible for their actions, as stipulated in article 1 of the Juveniles Act and in the provisions of the Libyan Penal Code that refer to criminal responsibility.
46- حددت سن الرشد بثمانية عشر عاماً السن التي يعد الأطفال عند بلوغها مسؤولين قانوناً عما يبدر عنهم من تصرفات وفقاً لنص المادة الأولى من قانون تنظيم شؤون القاصرين والنصوص المتعلقة بتنظيم المسؤولية الجنائية الواردة في قانون العقوبات الليبي.

1. You will recall the information provided in the fourth periodic report stating that the Libyan Criminal Code (arts. 390 and 393 to 395), in keeping with criminal and penal policy, classifies all forms of assault against women as criminal offences.
1- تذكرون ما أوردناه بالتقرير الدوري الرابع من أن قانون العقوبات الليبي وفي نهج السياسة التجريمية والعقابية جرم الاعتداء على المرأة بأي شكل من الأشكال بنصوص متفرقة منها المواد 390، و393-395.

As you are well aware, the Libyan Criminal Code recognizes the general principle of personal criminal liability. Women who are subjected to violence are afforded equal treatment with men in respect of protection procedures, legal remedies and other appropriate measures.
ولا يخفى عليكم أن المبدأ العام لقانون العقوبات الليبي هو " شخصية العقوبة " ، والمرأة التي تتعرض للعنف تعامل معاملة مساوية للرجل في الإجراءات التي تتخذ لحمايتها وإنصافها وكذلك التدابير اللازمة.
