Adopting a contextual and purposive interpretation of article 2 of the Covenant, the Human Rights Committee has confirmed that " a State party must respect and ensure the rights laid down in the Covenant to anyone within the power or effective control of that State party, even if not situated within the territory of the State party " .

In a similar vein, the Human Rights Committee, in its general comment No. 31, has stated that a State party must respect and ensure the rights laid down in the Covenant to anyone within the power or effective control of that State party, even if not situated within its territory (CCPR/C/21/Rev.1/Add.13, para. 10).

The extra-territorial applicability was elaborated by the Human Rights Committee in its general comment 31: " A State party must respect and ensure the rights laid down in the Covenant to anyone with the power or effective control of that State party, even if not situated within the territory of the State party. "

In relation to this observation the Working Group notes that the Human Rights Committee, which monitors implementation of the Covenant, has clarified that " a State party must respect and ensure the rights laid down in the Covenant to anyone within the power or effective control of that State party, even if not situated within the territory of the State party " .

In general comment No. 31 (2004), the HRC stated, " ... a State party must respect and ensure the rights laid down in the Covenant to anyone within the power or effective control of that State party, even if not situated within the territory of the State party " .

Guided by the principle that a State cannot avoid its international human rights obligations by taking action outside its territory which it would be prohibited from taking at home, State parties were required to respect and ensure the rights laid down in the Covenant to anyone within their power or effective control, even if not situated within the territory of a State party.
