He referred to the situation of the two indictees, Saif Qadhafi and Abdullah alSenussi, and the exchange of information on their situation including in response to legal queries the Office had received from them.
وأشار المدعي العام إلى حالة المتهمَين، سيف القذافي وعبد الله السنوسي، وإلى تبادل المعلومات بشأن وضعهما، بما في ذلك في إطار الرد على استفسارات قانونية وردت على المكتب من المتهمَين.

In October 2013, the Chamber of Accusation of the South Tripoli Court endorsed the indictment of 37 high-level figures of the former regime, including Saif al-Islam Qadhafi and former chief of intelligence Abdullah al-Senussi.

I have the honour to convey the Decision on the admissibility of the case against Abdullah Al-Senussi (the Decision) in relation to the case of The Prosecutor v. Saif Al-Islam Gaddafi and Abdullah Al-Senussi transmitted to me by the Registrar of the International Criminal Court (see annex).

The Registrar recalls that since the adoption of resolution 1970 (2011), the Prosecutor of the International Criminal Court decided to open an investigation into the situation in the Libyan Arab Jamahiriya and, on 16 May 2011, requested the PreTrial Chamber to issue warrants of arrest against Muammar Gaddafi, Saif alIslam Gaddafi and Abdullah El-Senussi.
وتشير رئيسة القلم إلى أن المدعي العام للمحكمة الجنائية الدولية قرر، منذ اعتماد القرار 1970 (2011)، أن يجري تحقيقا في الوضع القائم في الجماهيرية العربية الليبية، وطلب في 16 أيار/مايو 2011 إلى الدائرة التمهيدية أن تصدر أوامر باعتقال معمّر القذافي، وسيف الإسلام القذافي وعبد الله السنوسي.

By his letter, the Registrar, pursuant to article 17 of the Negotiated Relationship Agreement between the International Criminal Court and the United Nations, transmitted the decision of Pre-Trial Chamber I of the Court dated 31 May 2013 on the admissibility of the case against Saif Al-Islam Gaddafi before the Court in the case of The Prosecutor v. Saif Al-Islam Gaddafi and Abdullah Al-Senussi, for onward transmission to the Security Council.
فعملاً بالمادة 17 من الاتفاق الناظم للعلاقة بين منظمة الأمم المتحدة والمحكمة الجنائية الدولية، أَخطر رئيس قلم المحكمة في رسالته بالقرار الذي اتخذته الدائرة التمهيدية الأولى للمحكمة المؤرخ 31 أيار/مايو 2013 بشأن مقبولية الدعوى المرفوعة ضد سيف الإسلام القذافي أمام المحكمة، في إطار دعوى المدعي العام ضد سيف الإسلام القذافي وعبد الله السنوسي، وذلك لأغراض إبلاغ مجلس الأمن.

I have the honour to refer to my letter of 15 October 2013 (see S/2013/649) which transmitted the " Decision on the admissibility of the case against Abdullah A1-Senussi " (ICC-01/11-01111-466-Red) issued by Pre-Trial Chamber I on 11 October 2013 for onward transmission to the Security Council in the case of The Prosecutor v. Saif Al-lslam Gaddafi and Abdullah Al-Senussi.
يشرفني أن أشير إلى رسالتي المؤرخة 15 تشرين الأول/أكتوبر 2013 (انظر S/2013/649) التي نقلت " القرار المتعلق بمقبولية الدعوى ضد عبد الله السنوسي " (ICC-01/11-01111-466-Red) الصادر عن الدائرة التمهيدية الأولى في 11 تشرين الأول/أكتوبر 2013 تمهيدا لإحالته إلى مجلس الأمن في قضية المدعي العام ضد سيف الإسلام القذافي وعبد الله السنوسي.

The Prosecutor addressed the issue of the challenge of the admissibility of the cases of Saif al-Islam Qadhafi and Abdullah al-Senussi before the Court, and the necessity for the protection and security of judges, the Prosecutor and staff of the Court in the execution of their mandate.
وتطرقت المدعية العامة إلى مسألة الطعن في مقبولية قضيتي سيف الإسلام القذافي وعبد الله السنوسي أمام المحكمة، وضرورة تأمين حماية وأمن القضاة والمدعي العام للمحكمة وموظفيها خلال أدائهم لمهامهم.

She explained that since Libya had filed admissibility challenges with regard to the cases concerning Saif al-Islam Qadhafi and Abdullah al-Senussi before the Court, her Office had suspended investigations into those cases pending a ruling by the Pre-Trial Chamber.
وأوضحت أنه منذ أن قدمت ليبيا طعونا بشأن مقبولية قضيتي سيف الإسلام القذافي وعبد الله السنوسي أمام المحكمة، علق مكتبها التحقيقات في القضيتين المذكورتين ريثما تبث دائرة الإجراءات التمهيدية في الأمر.

The Panel continued to seek further details on all travel ban violations, with a particular focus in this period on Saadi Qadhafi and Abdullah Al-Senussi, the chief of the Libyan Intelligence Service under the Qadhafi regime.

Virtually all the Council members recalled that, in accordance with the principle of complementarity, it was for the Court to determine whether to uphold Libya's admissibility challenge and allow Libya to investigate and prosecute Saif al-Islam Qadhafi and Abdullah al-Senussi.
