2. Decides to transmit to the Commission on Human Rights the Norms on the responsibilities of Transnational Corporations and Other Business Enterprises with regard to Human Rights for consideration and adoption by the Commission;

The Special Rapporteur noted that transnational corporations have responsibilities for promoting and securing human rights, established under the " Norms on the responsibilities of transnational corporations and other business enterprises with regard to human rights " , adopted in 2003 by the Sub-Commission on the Promotion and Protection of Human Rights.

19. In 2003, the Sub-Commission issued a Commentary on the Norms on the responsibilities of transnational corporations and other business enterprises with regard to human rights (E/CN.4/Sub.2/2003/38/Rev.2).

4. Also recommends that after having received comments from Governments, United Nations bodies, specialized agencies, non-governmental organizations and other interested parties, the Commission on Human Rights consider establishing an open-ended working group to review the Norms on the responsibilities of Transnational Corporations and Other Business Enterprises with regard to Human Rights and the Commentary on the Norms;

14. The numerous tasks completed during the fifty-fifth session included the finalization and unanimous adoption of the Norms on the responsibilities of transnational corporations and other business enterprises with regard to human rights (E/CN.4/Sub.2/2003/12/Rev.2).
14- ومن بين الأعمال الكثيرة التي أنجزت خلال انعقاد الدورة الخامسة والخمسين، تجدر الإشارة إلى الانتهاء من صياغة القواعد المتعلقة بمسؤولية الشركات عبر الوطنية وغيرها من مؤسسات الأعمال في مجال حقوق الإنسان، واعتمادها بالإجماع (E/CN.4/Sub.2/2003/12/Rev.2).

3. Recommends that the Commission on Human Rights invite Governments, United Nations bodies, specialized agencies, non-governmental organizations and other interested parties to submit to it at its sixty-first session and to the Sub-Commission at its fiftyseventh session comments on the Norms on the responsibilities of Transnational Corporations and Other Business Enterprises with regard to Human Rights and the Commentary on the Norms;
3- توصي بأن تدعو لجنة حقوق الإنسان الحكومات وهيئات الأمم المتحدة والوكالات المتخصصة والمنظمات غير الحكومية وسائر الأطراف المعنية إلى أن تقدم إليها في دورتها الحادية والستين والى اللجنة الفرعية في دورتها السابعة والخمسين تعليقاتها على القواعد المتعلقة بمسؤولية الشركات عبر الوطنية وغيرها من مؤسسات الأعمال في مجال حقوق الإنسان، والتعليق على هذه القواعد؛

As a consequence of this, there was agreement in the Commission that, in principle, a breach of an obligation which arose out of the provisional application of a treaty constituted an internationally wrongful act, thereby triggering the rules on the responsibility of states for internationally wrongful acts.

Examples would be provisions concerning the law of treaties -- in particular, those related to supervening impossibility of performance and fundamental change of circumstances -- as well as the rules on the responsibility of States and international organizations, and the responsibility of individuals.
ومن ذلك على سبيل المثال الأحكام المتعلقة بقانون المعاهدات - لا سيما الأحكام المتصلة باستحالة أداء طارئة وحدوث تغير أساسي في الظروف - وكذلك القواعد المتعلقة بمسؤولية الدول والمنظمات الدولية ومسؤولية الأفراد.

8. Noting the different underlying purposes of the rules on the responsibility of States for internationally wrongful acts and the rules on immunity, it was pointed out that there may be reason to distinguish between a presumption of State responsibility and the final determination of the latter.

2. Several delegations welcomed the general structure of the draft articles, although the difficulty of encapsulating all rules of responsibility of various international organizations in a single text was emphasized.

33. Lastly, draft articles 31 and 32 should be understood simply as references to the rules concerning the responsibility of States for internationally wrongful acts and the legal institution of diplomatic protection, respectively.
