After precautionary measures have been adopted, cases are referred to the family courts which must also deal with divorces, successions, custody, visits and other matters relating to family law.

The Supreme Court of Justice currently comprises four courts: the First Chamber tries civil, commercial and contentious-administrative cases, the Second Chamber tries cases relating to family law, labour law and residuary decisions (inheritance and bankruptcy); the Constitutional Chamber is concerned with constitutional jurisdiction.

The Committee is concerned that in all actions concerning children, the general principle of the best interests of the child contained in article 3 of the Convention is not a primary consideration, including in matters relating to family law (e.g. duration of custody under the Personal Status Law is arbitrary as it is determined by the child's age, and is discriminatory against the mother).
33- يساور اللجنة القلق لأن المبدأ العام لمصالح الطفل الفضلى الوارد في المادة 3 من الاتفاقية لا يشكل اعتبارا أساسيا في جميع التدابير المتعلقة بالأطفال، بما في ذلك في المسائل المتصلة بقانون الأسرة (فمدة الحضانة مثلا في قانون الأحوال الشخصية مدة كيفية نظرا إلى أنها تحدد حسب سن الطفل، وتميز ضد الأم).
