This final report submitted by the Special Rapporteur reflects the results of this intensive consultation process and presents the Principles on housing and property restitution for refugees and displaced persons in their final version.

Attention is drawn to the Basic Principles and Guidelines on the Right to Remedy and Reparation for Victims of Gross Violations of International Human Rights Law and Serious Violations of International Humanitarian Law, the Guiding Principles on Internal Displacement, and the Principles on housing and property restitution for refugees and displaced persons.
ويُسترعى الاهتمام إلى المبادئ الأساسية والمبادئ التوجيهية بشأن الحق في الانتصاف والجبر لضحايا الانتهاكات الجسيمة للقانون الدولي لحقوق الإنسان والانتهاكات الخطيرة للقانون الإنساني الدولي، وإلى المبادئ التوجيهية المتعلقة بالتشرد الداخلي والمبادئ المتعلقة برد المساكن والممتلكات إلى اللاجئين والمشردين.

5. Requests the Office of the United Nations High Commissioner for Human Rights to circulate the draft principles on housing and property restitution for refugees and displaced persons widely among non-governmental organizations, Governments, specialized agencies and other interested parties for comment;

The present report provides the first foray into such a task, and includes the " Draft Principles on housing and property restitution for Refugees and Displaced Persons " , for consideration by the Sub-Commission.

5. Endorses the Principles on housing and property restitution for Refugees and Displaced Persons and encourages their application and implementation by States, intergovernmental organizations and other relevant actors;

COHRE has been engaged in work on the adoption of the Pinheiro Principles on housing and property restitution in the context of the return of refugees and displaced persons (E/CN.4/Sub.2/2005/17).
وما برح المركز منخرطا في العمل على اعتماد مبادئ بينهيرو المتعلقة برد المساكن والممتلكات في سياق عودة اللاجئين والمشردين (E/CN.4/Sub.2/2005/17).

In its resolution 2005/21, the Sub-Commission requested Mr. Pinheiro to compile and update the study on housing and property restitution for refugees and internally displaced persons so that it can be published in one volume as part of Human Rights Study Series, in all the official languages of the United Nations.
وطلبت اللجنة الفرعية، في قرارها 2005/21، من السيد بينهيرو أن يُجمّع ويستوفي الدراسة المتعلقة برد المساكن والممتلكات للاجئين والمشردين داخلياً بحيث يتسنى نشرها في مجلد واحد كجزء من سلسلة دراسات حقوق الإنسان بجميع اللغات الرسمية للأمم المتحدة.

6. Requests Mr. Pinheiro to compile and update the study on housing and property restitution for refugees and internally displaced persons so that it can be published in one volume as part of Human Rights Study Series, in all the official languages of the United Nations;
6- تطلب إلى السيد بنهيرو القيام بتجميع وتأوين الدراسة المتعلقة برد المساكن والممتلكات للاجئين والمشردين داخلياً بحيث يمكن نشر هذه الدراسة في مجلد واحد كجزء من سلسلة دراسات حقوق الإنسان وبجميع اللغات الرسمية للأمم المتحدة؛

In the humanitarian context, in 2005 the Principles on housing and property restitution for Refugees and Displaced Persons were developed (E/CN.4/Sub.2/2005/17).
وفي السياق الإنساني، وضعت في عام 2005 المبادئ المتعلقة برد المساكن والممتلكات إلى اللاجئين والمشردين (E/CN.4/Sub.2/2005/17).

11. Another important development was the formulation of the Principles on housing and property restitution for Refugees and Displaced Persons, generally known as the " Pinheiro Principles " .

Recalling the Global Housing Strategy of the United Nations Human Settlements Programme, the principles on housing and property restitution for refugees and displaced persons and the Voluntary Guidelines on the Responsible Governance of Tenure of Land, Fisheries and Forests in the Context of National Food Security,
وإذ يشير إلى الاستراتيجية العالمية للإسكان التي وضعها برنامج الأمم المتحدة للمستوطنات البشرية، والمبادئ المتعلقة برد المساكن والممتلكات إلى اللاجئين والمشردين()، والمبادئ التوجيهية الطوعية المتعلقة بالحوكمة المسؤولة لحيازة الأراضي ومصائد الأسماك والغابات في سياق الأمن الغذائي الوطني،

Moreover, the Guiding Principles on Internal Displacement and the Principles on housing and property restitution for Refugees and Displaced Persons offer guidance on measures to be taken to comply with the rights of displaced persons and refugees to the restitution of their housing, property and land.

To address these issues, Sub-Commission on the Promotion and Protection of Human Rights Special Rapporteur on housing and property restitution in the context of the return of refugees and internally displaced persons, Paulo Sérgio Pinheiro, proposed a set of draft principles on housing and property restitution for refugees and displaced persons in his 2004 interim report (E/CN.4/Sub.2/2004/22).

4. Welcomes the final report of the Special Rapporteur, Paulo Sérgio Pinheiro, on housing and property restitution in the context of the return of refugees and internally displaced persons (E/CN.4/Sub.2/2005/17), containing the Principles on housing and property restitution for Refugees and Displaced Persons as well as the explanatory notes on the Principles (E/CN.4/Sub.2/2005/17/Add.1);
