Recommendation 107, on the other hand, was intended to deal with a conflict of priority between two secured creditors that had both obtained security rights under the law on Secured Transactions, one by taking possession of the negotiable document and the other by obtaining a security interest in the goods or by some means other than taking possession of the negotiable document, in which case the former would prevail.

Mr. Bazinas (Secretariat) said that, as he understood it, recommendation 106 was intended to deal with a conflict between a secured creditor that had obtained a security right under the law on Secured Transactions and a secured creditor that had obtained a security right under the law governing negotiable documents by negotiating the negotiable document.

Like mortgages, security interests in movable property needed to be registered in a public registry so as to give potential creditors notice thereof; that was the recommendation contained in the UNCITRAL Legislative Guide on Secured Transactions of 2007 (the " Secured Transactions Guide " ) to States implementing modern secured transaction laws.

The view was expressed that the guide to enactment should clarify that, depending on its legislative methods, each enacting State should consider whether to deal with registry-related issues in its secured transactions law or in its registry regulations.
64- أُعرب عن رأي مفاده أن يوضِّح دليل الاشتراع أنَّه ينبغي لكل دولة مشترعة، تبعاً لطرائقها في التشريع، أن تنظر فيما إذا كانت ستعالج المسائل المتعلقة بالسجل في قانونها المتعلق بالمعاملات المضمونة أم في لوائحها التنظيمية الخاصة بالسجل.
