In this connection, the Committee recalls its general comment No. 32 on the right to equality before courts and tribunals and to a fair trial, which emphasizes, in paragraph 48, the need to review substantively the conviction and sentence.

In accordance with General Comment No. 32 of the Human Rights Committee, on the right to equality before courts and tribunals and to a fair trial, the imposition of the death sentence upon the conclusion of a trial that has not respected the provisions of article 14 of the International Covenant on Civil and Political Rights constitutes a violation of the right to life.
