All the courts and all the machinery of the State had to respect them; they were fully protected horizontally and vertically.

1- الحق في المعاملة على قدم المساواة أمام المحاكم وجميع الهيئات القضائية الأخرى التي تتولى إقامة العدل

Both regular and irregular migrants should therefore enjoy, inter alia, freedom of expression or association; freedom from racial discrimination in the areas of education or health; the right to equal treatment before the tribunals and all other organs administering justice; and a guarantee of their physical integrity by the State concerned.
ولذلك ينبغي أن يتمتع كل من المهاجرين النظاميين وغير النظاميين، في جملة أمور أخرى، بحرية التعبير وتكوين الجمعيات وفي التحرر من التمييز العنصري في مجالي التعليم أو الصحة؛ والحق في التساوي في المعاملة أمام المحاكم وجميع هيئات إقامة العدل الأخرى؛ وأن تضمن الدول المعنية سلامتهم البدنية.

(هـ) استحداث تدابير لضمان المساواة أمام القانون، لا سيما فيما يتعلق بالتمتع بالحق في المساواة في المعاملة أمام المحاكم وجميع الهيئات الأخرى التي تتولى إقامة العدل. ووضع تدابير فعالة للقضاء على الظاهرة المعروفة باسم " التنميط العنصري " ، وتنفيذ تلك التدابير وإنفاذها؛

In addition, article 5 of the International Convention on the Elimination of All Forms of Racial Discrimination, which is binding on 162 States, provides, among other things, for " the right to equal treatment before the tribunals and all other organs administering justice " .
ومن جهة أخرى، فإن المادة 5 من الاتفاقية الدولية للقضاء على جميع أشكال التمييز العنصري، والتي تسري على 162 دولة(36) تنص، من جملة ما تنص، على " الحق في معاملة على قدم المساواة أمام المحاكم وجميع الهيئات الأخرى التي تتولى إقامة العدل " .

The Committee recommends that the State party take firm action to guarantee the right of everyone, without distinction as to race, colour, or national or ethnic origin, to equal treatment before the courts and all other organs administering justice.
وتوصي اللجنة الدولة الطرف باتخاذ إجراء حازم لضمان حق كل شخص، دون أي تمييز على أساس العرق أو اللون أو الأصل القومي أو الإثني، في معاملة متساوية أمام المحاكم وجميع هيئات إدارة العدل.

(c) Promote and facilitate, within the courts and all administrative bodies, respect for the views of children and their participation in all matters affecting them, in accordance with article 12 of the Convention.
