The Prosecutor is responsible for the investigation and prosecution of persons indicted by the Tribunals as well as individuals who have knowingly and wilfully interfered in the administration of justice or given false testimony before the Mechanism, the International Criminal Tribunal for Rwanda, or the International Tribunal for the Former Yugoslavia.

30. During the reporting period, the efficiency of the Mechanism's judicial activities was improved by the recruitment of a small team of experienced legal staff, all of whom had served at either the International Criminal Tribunal for Rwanda or the International Tribunal for the Former Yugoslavia before joining the Mechanism.

Pursuant to article 10, paragraph 3, of the statute of the Mechanism, the judges of the Mechanism, who will be assigned to either the branch for the International Criminal Tribunal for Rwanda or the branch for the International Tribunal for the Former Yugoslavia of the Mechanism, shall be elected for a term of four years, beginning on 1 July 2012 and ending on 30 June 2016.
وعملا بالفقرة 3 من المادة 10 من النظام الأساسي للآلية، ينتخب قضاة الآلية، الذين سيعينون إما في فرع المحكمة الجنائية الدولية لرواندا أو فرع المحكمة الدولية ليوغوسلافيا السابقة، لمدة أربع سنوات تبدأ في 1 تموز/يوليه 2012 وتنتهي في 30 حزيران/يونيو 2016.

If, pursuant to the applicable law of the State in which the person convicted by the ICTY, the ICTR or the Mechanism is imprisoned, he or she is eligible for pardon or commutation of sentence, the State concerned shall notify the Mechanism accordingly.
إذا كان يجوز العفو عن شخص أدانته المحكمة الجنائية الدولية ليوغوسلافيا السابقة أو المحكمة الجنائية الدولية لرواندا أو الآلية، أو تخفيف الحكم الصادر بحقه، عملا بالقانون الساري في الدولة التي تحتجز في سجونها هذا الشخص، تخطر الدولة المعنية الآلية بذلك.

1. No person shall be tried before a national court for acts constituting serious violations of international humanitarian law under the present Statute, for which he or she has already been tried by the ICTY, the ICTR or the Mechanism.
1 - لا تجوز محاكمة شخص أمام محكمة وطنية على أفعال تشكل انتهاكات جسيمة للقانون الإنساني الدولي بموجب هذا النظام الأساسي تكون المحكمة الجنائية الدولية ليوغوسلافيا السابقة أو المحكمة الجنائية الدولية لرواندا أو الآلية قد حاكمته عليها بالفعل.

Where a new fact has been discovered which was not known at the time of the proceedings before the Single Judge, Trial Chamber or the Appeals Chamber of the ICTY, the ICTR or the Mechanism and which could have been a decisive factor in reaching the decision, the convicted person may submit to the Mechanism an application for review of the judgement.
عند ظهور حقيقة جديدة لم تكن معروفة وقت نظر القاضي المنفرد أو الدائرة الابتدائية أو دائرة الاستئناف في المحكمة الجنائية الدولية ليوغوسلافيا السابقة أو المحكمة الجنائية الدولية لرواندا أو الآلية في الدعوى قد تكون عاملا حاسما في البت فيها، يجوز للشخص المدان أن يقدم إلى الآلية طلبا لإعادة النظر في الحكم.

3. The Mechanism shall respond to requests for assistance from national authorities in relation to investigation, prosecution and trial of those responsible for serious violations of international humanitarian law in the countries of the former Yugoslavia and Rwanda, including, where appropriate, providing assistance in tracking fugitives whose cases have been referred to national authorities by the ICTY, the ICTR or the Mechanism.
3 - تلبي الآلية طلبات المساعدة المقدمة من السلطات الوطنية فيما يتعلق بالتحقيق مع المسؤولين عن الانتهاكات الجسيمة للقانون الإنساني الدولي في بلدان يوغوسلافيا السابقة ورواندا وملاحقتهم قضائيا ومحاكمتهم، بما في ذلك، عند الاقتضاء، تقديم المساعدة في تعقب الهاربين الذين تحيل المحكمة الجنائية الدولية ليوغوسلافيا السابقة أو المحكمة الجنائية الدولية لرواندا أو الآلية دعاويهم إلى السلطات الوطنية.

2. The Mechanism shall have the power to supervise the enforcement of sentences pronounced by the ICTY, the ICTR or the Mechanism, including the implementation of sentence enforcement agreements entered into by the United Nations with Member States and other agreements with international and regional organizations and other appropriate organizations and bodies.
2 - تكون للآلية سلطة الإشراف على تنفيذ الأحكام التي قضت بها المحكمة الجنائية الدولية ليوغوسلافيا السابقة أو المحكمة الجنائية الدولية لرواندا أو الآلية، بما في ذلك اتفاقات تنفيذ الأحكام التي تبرمها الأمم المتحدة مع الدول الأعضاء وغيرها من الاتفاقات المبرمة مع المنظمات الدولية والإقليمية والمنظمات والهيئات المعنية الأخرى.
