A sentenced person or his counsel have thus the right to address the Chairperson of the Supreme Court, the Chairpersons of the county courts or the chairpersons of the division of criminal cases of the above courts to submit cassation motions to the Supreme Court.
ولذلك يحق للشخص المحكوم عليه أو لمحاميه أن يتوجها إلى رئيس المحكمة العليا أو رؤساء محاكم المقاطعات أو رؤساء شعب الدعاوى الجنائية لهذه المحاكم من أجل تقديم طلبات النقض إلى المحكمة العليا.

Moreover, article 98 of the Penal Code deals with the confiscation of things manufactured, acquired, sold or used illegally, even if not owned by the defendant or the person sentenced or if the prosecution does not result in a judgement, provided, however, that these provisions are applicable to illegal assets and weapons.
كما أن المادة 98 من قانون العقوبات تتناول مصادرة الأشياء التي كان صنعها واقتناؤها أو بيعها أو استعمالها غير مشروع حتى لو لم تكن ملكا للمدعي عليه أو المحكوم عليه أو لم تؤد الملاحقة إلى حكم، مع الملاحظة أن هذه الأحكام تطبق على الأموال والأسلحة غير المشروعة.

The Presidency may also, of its own motion or at the request of the sentenced person or the State of detention, decide that the sentenced person be transferred to another State party for the continued serving of his sentence.
لهيئة الرئاسة أيضا أن تقرر تلقائيا أو بناء على طلب المحكوم عليه أو الدولة التي يجري فيها الاحتجاز، نقل المحكوم عليه إلى دولة طرف أخرى لمواصلة تنفيذ عقوبته.

ولا يحق للشخص المحكوم عليه أو محاميه إلا التوجه إلى هاتين الشخصيتين طالبين إليهما تقديم " الاعتراض الرقابي " .

1 - يجوز لهيئة الرئاسة، بناء على قرار نابع منها أو على طلب من الشخص المحكوم عليه أو من المدعي العام، أن تتصرف في أي وقت وفقا لأحكام الفقرة 1 من المادة 104؛

The Presidency shall assist the State in the enforcement of fines, forfeiture or reparation orders, as requested, with the service of any relevant notification on the sentenced person or any other relevant persons, or the carrying out of any other measures necessary for the enforcement of the order under the procedure of the national law of the enforcement State.
تقدم هيئة الرئاسة المساعدة للدولة في تنفيذ التغريم والمصادرة والتعويض، عند الطلب، مع تقديم أي إخطار ذي صلة بشأن الشخص المحكوم عليه أو أي أشخاص آخرين ذوي صلة بالموضوع، أو في اتخاذ أي تدبير آخر لازم لتنفيذ الأمر بموجب إجراءات القانون الوطني لدولة التنفيذ.

ويجوز ﻟ ]المحكمة[ ]هيئة الرئاسة[ أيضا أن تقرر، من تلقاء نفسها أو بناء على طلب الشخص المحكوم عليه أو طلب دولة التنفيذ، نقل الشخص المحكوم عليه إلى دولة أخرى لمواصلة تنفيذ الحكم ]بشرط موافقة تلك الدولة[.

" Things manufactured, acquired, sold or used illegally shall be confiscated, even if not owned by the defendant or the person sentenced or if the prosecution does not result in a judgement.
" يُصَادَر من الأشياء ما كان صنعه أو اقتناؤه أو بيعه أو استعماله غير مشروع وإن لم يكن ملكا للمدعى عليه أو المحكوم عليه أو لم تفضِ الملاحقة إلى حكم.

After deliberating, the court upheld the verdict of the court of first instance both as to civil and as to criminal law and, in the absence of an appeal from either the defendant or the prosecution service, the judgement became final.
وبعد المداولة، أقَرَّت المحكمة الحكم الصادر عن المحكمة الابتدائية بتونس، في فرعيه المدني والجنائي، على أن يصبح قرار المحكمة نهائياً في غياب طعن بالنقض من جانب المحكوم عليه أو المدعي العام.

(3) Either the convicted person or the foreign State has failed to provide guarantees that the sentence will be carried out, including with respect to a civil suit;
