Article 128 of the Civil Code (1999) confirms the right of a child not to be subjected to corporal punishment, but, as the Government has confirmed to the Committee on the Rights of the Child, this applies only to schools and other institutions.

36. CRC urged Canada to repeal section 43 of the Criminal Code to remove authorization of the use of " reasonable force " in disciplining children and prohibit all forms of violence against all age groups of children within family, in schools and in other institutions where children may be placed.
