51. After discussion, the Working Group failed to reach consensus as to whether the issue of court enforcement of preliminary orders should be dealt with in the revised draft of article 17.
51- وبعد المناقشة، لم يتمكّن الفريق العامل من التوصل إلى توافق في الآراء بشأن ما إذا كان ينبغي تناول مسألة إنفاذ المحاكم للأوامر الأولية في المشروع المنقّح للمادة 17.

The Working Group took note of that suggestion and requested the Secretariat to reflect it, as a possible variant, in the revised draft to be prepared for continuation of the discussion at a future session.

16. The revised draft legal instrument consists of a preamble and nine chapters.

First of all, the Netherlands expresses its gratitude to the UNCITRAL Secretariat for its excellent work with regard to the present revised draft.

6. Ms. Bowen (Jamaica), speaking on behalf of the sponsors, said that Austria, Croatia, Finland, France, Norway, San Marino, Slovakia and Sweden had joined in sponsoring the revised draft resolution.

It was said that subparagraph (a) of the revised draft proposal of article 1 (2) permitted departure from the rules on transparency only if the investment treaty permitted so.

67. After discussion, the Working Group decided that the discussion on paragraph (6) would be continued on the basis of the proposed revised draft, which would be placed in square brackets, after the review of draft article 17 had been completed.

22. One proposal was that the revised draft could be acceptable provided that it combined an opt-in approach for the parties and the deletion of paragraph (6) of article 17 bis, which dealt with enforcement of preliminary orders.
22- وذهب أحد الاقتراحات إلى أن المشروع المنقّح قد يكون مقبولا شريطة أن يجمع بين نهج الاختيار الصريح فيما يخص الطرفين وحذف الفقرة (6) من المادة 17 مكرّرا، التي تتناول إنفاذ الأوامر الأولية.

The Unit is also the focal point for contacts between the Division and Member States under the revised draft model memorandum of understanding (see A/61/19 (Part III)) regarding alleged misconduct by members of national contingents.
