The Office of the United Nations High Commissioner for Human Rights monitored trials in which several Kosovo Albanian defendants, in open court testimony, indicated that their statements during police detention and after arraignment before an investigative judge were made under ill-treatment or torture.
٢١ - ورصدت مفوضية اﻷمم المتحدة لحقوق اﻹنسان المحاكمات التي ذكر فيها عدة أشخاص مدعى عليهم من ألبانيي كوسوفو، في شهادة علنية أمام المحكمة، أن بياناتهم التي أدلوا بها خلال احتجاز الشرطة لهم وبعد الاستدعاء للمثول أمام قاضي التحقيق تمت تحت المعاملة السيئة أو التعذيب.

296. In connection with articles 12 and 13 of the Convention, members of the Committee requested further information on the procedures available to individuals to initiate charges and proceedings against ill-treatment or abuse of power committed by police authorities.
٢٩٦ - وفيما يتصل بالمواد ١٢ و ١٣ من الاتفاقية، طلب أعضاء اللجنة المزيد من المعلومات عن الاجراءات المتاحة لﻷفراد لرفع الدعاوى والملاحقة ضد المعاملة السيئة أو إساءة استخدام السلطة التي ترتكبها سلطات الشرطة.

Therefore, where a detainee or any other person alleges torture or other ill-treatment or where there is reason to believe that torture or other ill-treatment has happened, alleged victims should be given an immediate examination by a doctor who can make an accurate report without interference by the authorities.

10. To promote the implementation of the Optional Protocol on a communications procedure, domestic remedies and child-sensitive procedures and mechanisms need to be in place, to ensure respect for the views and the best interests of the child, to protect children's privacy and to prevent the risk of ill-treatment or intimidation.

However frustrating may be the search for those behind the abominable acts of terrorism and for evidence that would bring them to justice, I am convinced that any temptation to resort to torture or similar ill-treatment or to send suspects to countries where they would face such treatment must be firmly resisted.

Conditions such as poor sanitation, lack of nutritious food and medicines fall short of United Nations standards for the treatment of prisoners, and the worst conditions amount to ill-treatment or torture by some police officials during the interrogation stage.
فالظروف السائدة فيها، من قبيل ضعف المرافق الصحية والنقص في الأطعمة المغذية والأدوية لا ترقى إلى مستوى معايير الأمم المتحدة الدنيا لمعاملة السجناء، علماً بأن أسوأ هذه الظروف تصل إلى حد إقدام بعض موظفي الشرطة على المعاملة السيئة أو التعذيب خلال مرحلة الاستجواب(35).

With a view to providing a remedy for victims pursuant to articles 12, 13 and 14 of the Convention, Kuwait ensures that the competent authorities consider complaints promptly and impartially, and that protection is afforded to complainants and witnesses against all forms of ill-treatment or intimidation in connection with a complaint or related evidence.
كما ضمنت دولة الكويت من خلال السلطات المختصة حق الأفراد في نظر الشكاوى على وجه السرعة وبالنزاهة التي يتمتع بها الجهاز القضائي، واتخاذ الخطوات اللازمة لضمان حمايتهم والشهود من كافة أنواع المعاملة السيئة أو التخويف نتيجة الشكوى أو لأي أدلة تقدم فيها، بما يكفل إنصاف الضحايا، وذلك اتفاقاً مع أحكام المواد 12، و13، و14 من الاتفاقية.

19. The Convention against Torture refers to the duty of States parties to ensure that any individual who alleges he has been subjected to torture in any territory under its jurisdiction has the right to complain ... and that the complainant and witnesses are protected against all ill-treatment or intimidation as a consequence of his complaint or any evidence given (article 13).
19- وتشير اتفاقية مناهضة التعذيب إلى واجب الدول الأطراف في أن تضمن لأي فرد يدّعي بأنه تعرض للتعذيب في أي إقليم يخضع لولايتها القضائية الحق في أن يرفع شكوى (....) وحماية مقدّم الشكوى والشهود من كافة أنواع المعاملة السيئة أو التخويف نتيجة لشكواه أو لأي أدلة تُقدّم (المادة 13).

According to some of these reports: (a) some judges refuse to register complaints of ill-treatment or torture; (b) some inquiries ordered subsequent to such complaints take an unreasonable amount of time; and (c) some superiors responsible for the conduct of their agents, in violation of article 7 of the Covenant, are neither investigated nor prosecuted.
وتفيد بعض هذه المعلومات بما يلي: (أ) أن بعض القضاة يرفضون تسجيل شكاوى تتعلق بحالات المعاملة السيئة أو التعذيب؛ (ب) أن التحقيقات التي أجريت على أثر هذه الشكاوى تتجاوز الآجال المعقولة؛ (ج) أن بعض كبار الموظفين المسؤولين عن سلوك أعوانهم الذي يشكل خرقاً لأحكام المادة 7 من العهد، لا يخضعون لأي تحقيق أو ملاحقة.
