25- وفيما يتعلق بالصعوبات التي تعترض تطبيق المعايير والقواعد المتعلقة بالعدالة التصالحية، أفادت دولة واحدة مُجيبة بأن المهنيين فيها يواجهون صعوبة في شرح ضرورة أن تكون الوساطة، بوصفها جزءا من عملية العدالة التصالحية، طوعية فيما يتعلق بمرتكب الجريمة والضحية على السواء، للسياسيين وإقناعهم بذلك.
