On 11 July 1989, SEOG entered into a further contract with Niigata for completion of the remaining work at the Basrah Refinery Complex.
391- وفي 11 تموز/يوليه 1989، أبرمت المقاولة العامة مع نيغاتا عقداً إضافياً من أجل استكمال الأعمال المتبقية في مجمع مصفاة البصرة.

Niigata alleges that it invoiced this amount to SEOG in July 1990, but it did not provide a copy of the relevant invoice;

327- وتعلن شيودا في بيان المطالبة أن المقاولة العامة أصدرت أمر شراء في 7 آذار/مارس 1990 يطلب إلى شيودا الاضطلاع بهذه العملية لفائدة مصفاة البصرة.

Chiyoda states in the Statement of Claim that SEOG issued several purchase orders requesting Chiyoda to undertake procurement work at the Basrah Refinery.
332- وتعلن شيودا في بيان المطالبة أن المقاولة العامة أصدرت أوامر شراء عدة تطلب فيها إلى شيودا الاضطلاع بمهمة الشراء لفائدة مصفاة البصرة.

Niigata seeks compensation in the total amount of USD 1,457,674 for retention monies allegedly withheld by SEOG.
أموال الضمان المحتجزة 396- تلتمس نيغاتا تعويضاً قدره 674 457 1 دولاراً أمريكياً عن أموال الضمان المحتجزة التي زعمت أن المقاولة العامة احتبستها.

Niigata alleges that it was then required to " donate " the goods to SEOG because it was unable to export them, and was also obliged to pay compensation to its subcontractors for the value of the goods.

The evidence provided by Chiyoda included a copy of the purchase order from SEOG to Chiyoda in the amount of JPY 1,242,000, as well as a copy of the irrevocable letter of credit dated 22 April 1990 and the bill of exchange dated 31 July 1990 established by SEOG in favour of Chiyoda in the amount of JPY 1,242,000.
