[C]: Concerning ad hoc holding areas, the Committee, while taking note of the information provided by the State party, considers that its recommendation to repeal article L221-2 of the Code on the Entry and Residence of Aliens and the Right of Asylum in the version introduced by the law of 16 June 2011 has not been implemented.

While noting the explanations provided by the State party, the Committee is deeply concerned at the repeated ethnic conflicts and clashes which occurred in the State party between the majority of the population and some ethnic groups, namely Uzbeks, Dungans, Kurds and Meskhetian Turks since 2007 and at their root causes of such conflicts.

The Committee reiterates its concern about the uncertain status of the Covenant in the legal system of the State party, which was not sufficiently clarified in the written responses, the oral replies of the delegation, as well as the additional information provided by the State party after the consideration of report by the Committee. (10) Information provided by the State party indicates that the Bolivian police force dealt with 42 individual cases (28 involving men and 14 involving women) of ill-treatment or torture (article 295 of the Criminal Code) between 2001 and 2012, while the Attorney General's Office registered 36 reports (31 involving men and 5 involving women) between March 2006 and February 2013.

The present report is submitted in accordance with rule 54, paragraph 3, of the Committee's rules of procedure, which reads: " The follow-up Rapporteur(s) shall assess the information provided by the State party in consultation with the country Rapporteurs, if any, and report at every session to the Committee on her/his activities " .

5.2 The authors find illogical the information presented by the State party in respect of the investigation into the death of Mr. Sa.K. They claim that, each time, the State party invents new names for the alleged perpetrators, since the names referred to in its observations are different from the ones presented by the investigative bodies to the family in 1999.
5-2 ويرى أصحاب البلاغ أن المعلومات المقدَّمة من الدولة الطرف غير منطقية فيما يتعلق بالتحقيق في مقتل السيد س. ك. ويدّعون أن الدولة الطرف تختلق في كل مرة أسماء جديدة للجناة المزعومين، والأسماء المشار إليها في ملاحظاتها تختلف عن الأسماء التي قدّمتها أجهزة التحقيق إلى عائلته عام 1999.
