1. Introductory remarks by the Special Rapporteur of the Sub-Commission on Prevention of Discrimination and Protection of Minorities, Mrs. Erica-Irene Daes.
١- ملاحظـات افتتاحية تقدمها المقررة الخاصة للجنة الفرعية لمنع التمييز وحماية اﻷقليات، السيدة إيريكا - إيرين أ.

In this regard, the Special Rapporteur of the Sub-Commission on Prevention of Discrimination and Protection of Minorities, Baroness Elles, expressed the view that, contrary to the situation of specific categories of aliens such as refugees, who may only be expelled for grounds related to national security or public order, such a restriction does not apply to aliens in general.
وفي هذا الصدد، أعربت المقررة الخاصة للجنة الفرعية لمنع التمييز وحماية الأقليات، البارونة إليس، عن رأي مفاده أنه، خلافا لحالة فئات محددة من الأجانب من قبيل اللاجئين الذي لا يجوز طردهم إلا لأسباب تتعلق بالأمن الوطني أو النظام العام، فإن هذا القيد لا يسري على الأجانب عموما.

As far as racial discrimination is concerned, the Special Rapporteur of the Sub-Commission on Prevention of Discrimination and Protection of Minorities, Baroness Elles, supported the view that discriminatory expulsions on racial grounds are contrary to international law:

This section draws largely on the report prepared by Sub-Commission Special Rapporteur Nicole Questiaux (E/CN.4/Sub.2/1982/15), and general comments Nos. 5 and 29 of the Human Rights Committee.

18. At its sixteenth session, the Committee recommended that relations be maintained with the Special Rapporteur of the Subcommission on Prevention of Discrimination and Protection of Minorities with respect to traditional practices affecting the health of women and children.
١٨ - وفي الدورة السادسة عشرة، أوصت اللجنة بالاحتفاظ بالعلاقات القائمة مع المقررة الخاصة للجنة الفرعية لمنع التمييز وحماية اﻷقليات فيما يتصل بالممارسات التقليدية التي تؤثر على صحة النساء واﻷطفال.

At its twenty-first session, the Working Group on Indigenous Populations decided to continue its standard-setting activities by reviewing the draft principles and guidelines on the heritage of indigenous peoples elaborated by Mrs. Erica-Irene Daes, Special Rapporteur of the Subcommission on the Promotion and Protection of Human Rights, in 1995.
1- قرر الفريق العامل المعني بالسكان الأصليين في دورته الحادية والعشرين مواصلة أنشطة وضع المعايير من خلال استعراض مشروع المبادئ والمبادئ التوجيهية المتعلقـة بتراث الشعوب الأصلية، التي أعدتها في عام 1995 السيـدة إيريكا - إيرين دايس، المقررة الخاصة للجنة الفرعية لحماية وتعزيز حقوق الإنسان.

The Special Rapporteur of the Sub-Commission on discrimination in the criminal justice system goes further in saying that " discrimination is not confined to the police but is also practiced by other participants in the criminal justice process.
12- وتتابع المقررة الخاصة للجنة الفرعية المعنية بالتمييز في نظام العادلة الجنائية فتقول إن " ممارسات التمييز لا تنحصر في الشرطة، وإنما تمارسها أيضاً عناصر فاعلة أخرى في العملية الجنائية.

(d) In connection with item 6: Mrs. J.S. Attah, Special Rapporteur of the Sub-Commission on monitoring the transition to democracy in South Africa;

32. At the present session, the Commission will have before it the report of the Special Rapporteur of the Sub-Commission (E/CN.4/1995/24).
٢٣ - وسيكون معروضا على لجنة حقوق اﻹنسان في هذه الدورة تقرير المقررة الخاصة للجنة الفرعية )E/CN.4/1995/24(.

In addition, an indigenous representative from Asia suggested that the Special Rapporteur of the Sub-Commission, Ms. Erica-Irene A. Daes, continue her study on the protection of the heritage of indigenous people with a special focus on the human genome diversity project.
وإضافة إلى ذلك، اقترح ممثل للسكان اﻷصليين من آسيا أن تواصل المقررة الخاصة للجنة الفرعية السيدة أريكا - إيرين دايس، دراستها لحماية تراث الشعوب اﻷصلية على أن تركز تركيزاً خاصاً على مشروع تنوّع مجموعة العوامل الوراثية البشرية.

37. The Commission also requested the Secretary-General to submit to the Commission at its fifty-second session, a report containing the opinions of Governments, specialized agencies and intergovernmental and non-governmental organizations on the issues raised in the report of the Special Rapporteur of the Sub-Commission.
٧٣- كما رجت اللجنة من اﻷمين العام أن يقدم اليها في دورتها الثانية والخمسين تقريراً يتضمن آراء الحكومات والوكالات المتخصصة والمنظمات الحكومية الدولية وغير الحكومية بشأن المسائل المثارة في تقرير المقررة الخاصة للجنة الفرعية.

The Commission will have before it a note by the Secretary-General (E/CN.4/1997/81) transmitting the report of the Special Rapporteur of the Sub-Commission (E/CN.4/Sub.2/1996/6). Item 17.
وستعرض على اللجنة مذكرة من اﻷمين العام )E/CN.4/1997/81( يحيل بها تقرير المقررة الخاصة للجنة الفرعية )E/CN.4/Sub.2/1996/6(.

2. In paragraph 8, the Commission requested the Secretary-General to submit to it, at its fifty-second session, a report containing the opinions of Governments, specialized agencies and intergovernmental and non-governmental organizations on the issues raised in the report of the Sub-Commission's Special Rapporteur.
٢- وتقتضي الفقرة ٨ من هذا القرار من اﻷمين العام أن يقدم إلى اللجنة، في دورتها الثانية والخمسين، تقريرا يتضمن آراء الحكومات والوكالات المتخصصة والمنظمات الحكومية الدولية والمنظمات غير الحكومية بشأن المسائل المثارة في تقرير المقررة الخاصة للجنة الفرعية.
