With regard to the report of the Special Rapporteur on the use of mercenaries (A/51/392), his delegation reiterated its repudiation of mercenary activities, as they constituted a violation of the Charter and of peoples' right to self-determination.
٣٤ - أما فيما يتعلق بتقرير المقرر الخاص المعني باستخدام المرتزقة )A/51/392(، فإن وفده يكرر استنكاره ﻷنشطة المرتزقة، ﻷنها تشكل انتهاكا للميثاق ولحق الشعوب في تقرير المصير.

1. In its resolution 2005/2 of 7 April 2005, the Commission on Human Rights decided to end the mandate of the Special Rapporteur on the use of mercenaries as a means of violating human rights and impeding the exercise of the right to self-determination and to establish a working group, made up of one expert from each of the five regional groups, for a period of three years.

The Special Rapporteur on the use of mercenaries to Undermine the Right of the Peoples to Self-determination and the Deputy to the Director, New York Office, Office of the United Nations High Commissioner for Human Rights responded to questions raised by the representatives of Finland (on behalf of the European Union), Liechtenstein, the Islamic Republic of Iran and Austria.

Mr. Bernales Ballesteros (Special Rapporteur on the use of mercenaries) introduced his report (A/53/338, annex), prepared in accordance with General Assembly resolution 52/112, and urged the Office of the High Commissioner for Human Rights to publicize the adverse effects of mercenary activities on the right to self-determination, as requested in that resolution.

Ms. Astiasarán Arias (Cuba) said that the draft resolution emphasized the importance of strengthening the international legal framework that regulated the use, financing and training of mercenaries, bearing in mind the report of the Special Rapporteur on the use of mercenaries as a means of impeding the exercise of the right of peoples to self-determination.

Mr. Bernales Ballesteros (Special Rapporteur on the use of mercenaries) said that, aside from a number of United Nations resolutions that condemned mercenary activities, article 47 of Protocol I Additional to the Geneva Conventions of 1949, as indicated in his report (A/53/338, annex, para. 48), was the only universal international provision in force which contained a definition of a “mercenary”.
