The Convention not only reaffirms the right of all to be free from torture, cruel, inhuman, degrading treatment or punishment, but requires States parties to take all effective legislative, administrative, judicial or other measures to prevent persons with disabilities from being subjected to these repellent practices.
فالاتفاقية لا تعيد فحسب تأكيد حق الجميع في التحرر من التعذيب والمعاملة أو العقوبة القاسية واللاإنسانية والمهينة، بل توجب على الدول الأطراف فيها اتخاذ كافة التدابير التشريعية والإدارية والقضائية الفعالة وما في حكمها من التدابير للحؤول دون تعرض الأشخاص ذوي الإعاقات لهذه الممارسات البغيضة.

٢١- وقد أدت اﻷزمة الاقتصادية العالمية وحركات الهجرة، إلى جانب آثار وأسباب أخرى، إلى ظهور نظريات وتصرفات تمييز عنصري من جديد في بعض البلدان، مما يجعل من الضروري التحرك بقوة لمنع ومكافحة هذه الممارسات البغيضة تماما.
