This requirement is essential to ensure transparency, integrity and the fair and equitable treatment of all suppliers and contractors in procurement proceedings.
وهذا الشرط ضروري لضمان الشفافية والنـزاهة والمعاملة العادلة والمنصفة لجميع المورِّدين والمقاولين في إجراءات الاشتراء.

This minimum information enables suppliers and contractors to submit tenders that meet the needs of the procuring entity and to verify that the procuring entity can compare tenders in an objective and fair manner.

It may also enhance competition as it would enable more suppliers and contractors to learn about procurement opportunities, assess their interest in participation and plan their participation in advance accordingly.
كما قد يؤدِّي إلى زيادة التنافس، إذ يتيح لمزيد من المورِّدين والمقاولين أن يطّلعوا على فرص الاشتراء، وأن يقيّموا مدى مصلحتهم في المشاركة فيها، وأن يخططوا مسبقا لتلك المشاركة تبعا لذلك التقييم.

When the submission of a tender fails, particularly arising from the protective measures taken by the procuring entity to prevent the system from being damaged as a result of a receipt of a tender, it shall be considered that no submission was made, as an application of the general rule that the submission of tenders is at the risk of the suppliers or contractors.
وفي حال إخفاق تقديم عطاء ما، وخصوصاً من جرّاء التدابير الحمائية التي تتّخذها الجهة المشترية لمنع إتلاف النظام نتيجة لتسلُّم عطاء على نحوٍ ما، يجب اعتبار تقديم العطاء كأنه لم يتم، وذلك تطبيقاً للقاعدة العامة التي تقضي بأنَّ مسؤولية تقديم العطاءات تقع على عاتق المورِّدين والمقاولين.

This can render access of potential suppliers and contractors, especially smaller companies, to procurement impossible or discourage their participation because of additional difficulties or increased costs.
وربما يجعل هذا الأمر إمكانية مشاركة المورِّدين والمقاولين المحتملين، وخصوصا الشركات الصغيرة، في عملية الاشتراء مستحيلة أو يثنيهم عن المشاركة بسبب الصعوبات الإضافية أو التكاليف الزائدة.

The article is supplemented by requirements in the Model Law that information on these matters be provided to suppliers and contractors at the outset of the procurement proceedings.

The suggestion was therefore made to delete the words " , especially where appropriate, participation by suppliers and contractors " in that paragraph.

Concern was expressed about the scope of the article, which dealt only with the conduct of the procuring entity and not with the conduct of suppliers and contractors and was therefore considered to be too narrow.
83- أُعرب عن القلق من أنَّ نطاق هذه المادة يُعتبر ضيقا جدا، فهي تتناول سلوك الجهة المشترية فقط، ولا تتناول سلوك المورِّدين والمقاولين.

The exercise of this right by the procuring entity is subject to a number of conditions that aim at ensuring that procuring entities do not use technology and processes for discriminatory or otherwise exclusionary purposes, such as to prevent access by some suppliers and contractors to the procurement or create barriers for access.

The enacting State should carefully assess the implications of charging fees for suppliers and contractors to access the procurement, in order to preserve the objectives of the Model Law, such as those of fostering and encouraging participation of suppliers and contractors in procurement proceedings, and promoting competition.
وينبغي للدولة المشترعة أن تُقيّم بعناية ما يترتب على فرض الرسوم من تبعات في وصول المورِّدين والمقاولين إلى عملية الاشتراء، من أجل الحفاظ على أهداف القانون النموذجي، كهدفيْ تعزيز وتشجيع مشاركة المورِّدين والمقاولين في إجراءات الاشتراء، وتشجيع التنافس.

So as to enhance confidence and transparency in the procurement process, any protective measures that might affect the rights and obligations of potential suppliers and contractors should be specified to suppliers and contractors at the outset of procurement proceedings or should be made generally known to public.
وتعزيزا للثقة والشفافية في عملية الاشتراء، ينبغي أن تُحدَّد للمورِّدين والمقاولين في بداية إجراءات الاشتراء أيُّ تدابير وقائية قد تؤثّر على حقوق المورِّدين والمقاولين المحتملين والتزاماتهم، أو ينبغي أن تُعلَنَ تلك التدابيرُ على الملأ.

3. Paragraph (1) does not mean " domestic procurement " only in the sense that domestic suppliers or contractors alone, however they may be defined in the enacting State, are permitted to participate in the procurement proceedings (noting that domestic procurement removes the obligation of international solicitation under article 32).
