29- وفي ما يتعلق بالخسائر المتصلة بعقود لم يكن العراق طرفاً فيها، يمكن لصاحب المطالبة أن يثبت وقوع خسارة مباشرة إذا كان قادراً على أن يثبت أن غزو العراق واحتلاله للكويت أو انهيار النظام المدني في العراق أو الكويت إثر غزو العراق، قد سبب قيام صاحب المطالبة بإجلاء الموظفين اللازمين لتنفيذ العقد.

52- أما بالنسبة للخسائر المتصلة بعقود لم يكن العراق طرفاً فيها، فيمكن لصاحب المطالبة أن يثبت وقوع خسارة مباشرة إذا كان قادراً على أن يثبت أن غزو العراق واحتلاله للكويت أو انهيار النظام المدني في العراق أو الكويت إثر غزو العراق قد أجبره على إجلاء الموظفين اللازمين لتنفيذ العقد.

50- أما بالنسبة للخسائر المتصلة بعقود لم يكن العراق طرفاً فيها، فيمكن لصاحب المطالبة أن يثبت وقوع خسارة مباشرة إذا كان قادراً على أن يثبت أن غزو العراق واحتلاله للكويت أو انهيار النظام المدني في العراق أو الكويت إثر غزو العراق قد أجبره على إجلاء الموظفين اللازمين لتنفيذ العقد.

(a) with respect to physical assets in Iraq and in Kuwait on 2 August 1990, a claimant can prove a direct loss by demonstrating that the breakdown in civil order in those countries, which resulted from Iraq's invasion and occupation of Kuwait, caused the claimant to evacuate its employees and that the evacuation resulted in the abandonment of the claimant's physical assets;
(أ) فيما يتعلق بالأصول المادية في العراق والكويت في 2 آب/أغسطس 1990، يمكن للمطالب أن يثبت الخسارة المباشرة بالبرهنة على أن انهيار النظام المدني في العراق أو الكويت، الذي نجم عن غزو العراق واحتلاله الكويت، تسبب في قيام المطالب بإجلاء مستخدميه وأن الإجلاء أسفر عن التخلي عن الأصول المادية للمطالب؛

52- أما بالنسبة للخسائر المتصلة بعقود لم يكن العراق طرفاً فيها، فيمكن لصاحب المطالبة أن يثبت وقوع خسارة مباشرة إذا كان قادراً على أن يثبت أن غزو العراق واحتلاله للكويت أو انهيار النظام المدني في العراق أو الكويت إثر غزو العراق قد أجبره على إجلاء الموظفين اللازمين لتنفيذ العقد.

The MOI contends that the Allied Coalition Forces encouraged civil unrest and rebellion in Iraq as part of their military strategy against Iraq and that they undertook military operations that inevitably led to the breakdown of civil order in Iraq.
159- وتزعم وزارة الداخلية أن قوات التحالف شجعت على نشوب اضطرابات مدنية وتمرد في العراق كجزء من استراتيجيتها العسكرية ضد العراق وقد باشرت عمليات عسكرية أدت بصورة حتمية إلى انهيار النظام المدني في العراق.

(a) with respect to physical assets in Iraq and in Kuwait on 2 August 1990, a claimant can prove a direct loss by demonstrating that the breakdown in civil order in those countries, which resulted from Iraq's invasion and occupation of Kuwait, caused the claimant to evacuate its employees and that the evacuation resulted in the abandonment of the claimant's physical assets;
