The Commission, on the basis of a note by the Secretariat entitled " Status of the Hamburg Rules " (A/CN.9/401/Add.1), discussed the status of the United Nations Convention on the carriage of goods by sea, 1978 (Hamburg) ( " the Hamburg Rules " ), which entered into force on 1 November 1992 and currently had 22 States parties.

As had been the case in the previous session, the Commission had expressed its concern about the situation that had arisen in the law regarding the transport of goods by sea, as a result of the coexistence of the liability regime of the Hamburg Rules with the International Convention for the Unification of Certain Rules relating to Bills of Lading (Hague Rules).
