Decides to adopt the Basic Principles and Guidelines on the Right to a Remedy and Reparation for Victims of violations of international human rights and Humanitarian Law as follows:
تقرر اعتماد المبادئ الأساسية والخطوط التوجيهية بشأن الحق في الانتصاف والجبر لضحايا انتهاكات حقوق الإنسان الدولية والقانون الإنساني الدولي، وهذه المبادئ والخطوط هي:

The Commission, therefore, selected incidents and areas that were most representative of acts, trends and patterns relevant to the determination of violations of international human rights and humanitarian law and with greater possibilities of effective fact-finding.

4- تشدد على أهمية اتخاذ كافة الخطوات الضرورية والممكنة لمحاسبة مقترفي انتهاكات حقوق الإنسان الدولية والقانون الإنساني الدولي، وتحث الدول على اتخاذ تدابير وفقاً للإجراءات القانونية؛

Convinced that, in adopting a victim-oriented point of departure, the community, at local, national and international levels, affirms its human solidarity and compassion with victims of violations of international human rights and humanitarian law as well as with humanity at large,
واقتناعاً منها أن المجتمع الدولي، باعتماده منطلق الحرص على المجني عليهم على الصعيد المحلي والوطني والدولي، يؤكد تضامنه وتعاطفه الإنسانيين مع ضحايا انتهاكات حقوق الإنسان الدولية والقانون الإنساني الدولي ومع الإنسانية عموماً،

Adequate, effective and prompt reparation shall be intended to promote justice by redressing violations of international human rights or humanitarian law.
15- يقصد بالجبر الكافي والفعال والفوري تعزيز العدالة بالانصاف في انتهاكات حقوق الإنسان الدولية أو القانون الإنسان الدولي.

Restitution should, whenever possible, restore the victim to the original situation before the violations of international human rights or humanitarian law occurred.
22- يجب أن يوفر الاسترداد كلما أمكن رد حالة الضحية إلى ما كانت عليه في الأصل قبل وقوع انتهاكات حقوق الإنسان الدولية أو القانون الإنساني الدولي.

Compensation should be provided for any economically assessable damage resulting from violations of international human rights and humanitarian law, such as:
23- يجب التعويض عن أي ضرر يمكن تقييمه اقتصادياً ويكون ناجماً عن انتهاكات حقوق الإنسان الدولية والقانون الإنساني الدولي مثل:

It will be recalled that it was in the Sub-Commission that the basic principles and guidelines on the right to a remedy and reparation for victims of violations of international human rights and humanitarian law were first discussed.
12- ويجدر بالذكر أن المبادئ الأساسية والخطوط التوجيهية بشأن الحق في الانتصاف وجبر الأضرار لضحايا انتهاكات حقوق الإنسان الدولية والقانون الإنساني الدولي قد نوقشت لأول مرة في اللجنة الفرعية.
