52. The Conference recognized that the Kosovo issue has entered into a new and crucial phase of the negotiations in the UN Security Council. It also recognized Mr. Ahtisaari's efforts and other contributions and considered that the outcome in this regard would contribute to the maintenance of the stability in Kosovo.

Mr. Ahtisaari's Letter of Appointment included, as an annex to it, a document entitled " Terms of Reference " which stated that the Special Envoy " is expected to revert to the Secretary-General at all stages of the process " .

The Ahtisaari plan provides ample protection for Serbs and an international presence in Kosovo – which the US and the EU will need to deploy even without a new Security Council resolution – to ensure implementation. Ironically, Serbia’s resistance to the Ahtisaari plan undermines protection for Kosovo’s Serbs and increases the risk that they will be mistreated.

EU intensified preparations for its civil mission in Kosovo pursuant to the " Ahtisaari Plan " as if the negotiations on the status of Kosovo were brought to an end and as if this Plan had already been adopted in the UN Security Council; they have even announced vacancies for local staff for a possible EU Mission in Kosovo despite the negotiations on the status of Kosovo which were carried out with the EU representative as a moderator;
(ح) كثف الاتحاد الأوروبي عمليات التحضير لبعثته المدنية في كوسوفو، عملا بـ " خطة اهتيساري " كما لو أن المفاوضات بشأن مركز كوسوفو قد أنهيت، وكما لو أن هذه الخطة قد اعتمدت بالفعل في مجلس الأمن؛ بل إنهم أعلنوا عن شواغر لتعيين موظفين محليين في ضوء احتمال قدوم بعثة للاتحاد الأوروبي إلى كوسوفو على الرغم من المفاوضات المتعلقة بمركز كوسوفو التي جرت مع ممثل الاتحاد الأوروبي بوصفه مشرفا؛

Furthermore, " [t]he pace and duration of the future status process will be determined by the Special Envoy on the basis of consultations with the Secretary-General, taking into account the cooperation of the parties and the situation on the ground " (Terms of Reference, dated 10 November 2005, as an Appendix to the Letter of the Secretary-General to Mr. Martti Ahtisaari of 14 November 2005, United Nations dossier No. 198).
