١٩٥ - وبما أنه لا توجد معلومات عن التدابير التشريعية التي اتخذت تنفيذا للمادة ٦ من الاتفاقية، فإن عدم وجود حالات ﻹقامة دعاوى قضائية تتعلق بأعمال التمييز العنصري لا يمكن اعتباره دليلا على عدم وجود ذلك التمييز.

The Committee recommends that the next report contain detailed information on the effective implementation of the provisions of the Penal Code, allegations and prosecutions of cases of acts of racial discrimination, and complaints and penalties relating to acts of racial and ethnic discrimination.

The Committee recommends that the State party consider sharing the burden of proof in civil and administrative proceedings once the commission of an act of racial discrimination has been sufficiently substantiated by the complainant, and that it allocate sufficient funds to witness protection programmes in cases concerning acts of racial discrimination.
