2 - ما لم تنص المعاهدة على حكم مخالف أو ما لم تكن الدول المتفاوضة قد اتفقت على إجراء مخالف، ينتهي التطبيق المؤقت للمعاهدة أو لجزء من المعاهدة بالنسبة إلى دولة ما إذا قامت تلك الدولة بإخطار الدول التي تطبق عليها المعاهدة بصورة مؤقتة بنيتها بألا تصبح طرفا في المعاهدة.

Indeed, it would seem that the fact that the Prosecutor is not obliged to notify States parties of a Security Council referral is justified by the fact that in such a case all States are presumed to know of the referral, given that acts of that body are public and widely known.
