One country and an NGO stressed that the process should be forward-looking: it should not dwell on past instances of non-compliance with the Convention or protocol, but instead on how to assist Parties achieve compliance in the future.

Moreover, the Chairman proposed, as a compromise solution, that a list of offences, which could be either indicative or exhaustive, such as the list originally contained in article 2, paragraph 3, could be included either in an annex to the Convention or in the travaux préparatoires.
