• Territorial Asylum

Its draft convention on Territorial Asylum defines the two terms as follows:
وكان مشروع الاتفاقية المتعلقة باللجوء الإقليمي الذي أعدته قد حدد المصطلحين على التوالي على النحو التالي:

There is no national legislation on Territorial Asylum.
لا يوجد تشريع وطني يتعلق باللجوء الإقليمي.

74. This rule is reinforced by the Declaration on Territorial Asylum, article 1, paragraph 1, of which states:
74 - وتجد هذه القاعدة الموضوعة تأكيدا لها في الإعلان المتعلق باللجوء الإقليمي الذي ينص في مادته الأولى على أنه:

Host countries must, in particular, respect the principle of non-refoulement. In other words, they must not expose refugees once again to the dangers they had fled by expelling them or returning them to the border. The latter had been taken into account in the Declaration on Territorial Asylum.
ومن المستحسن ببلدان الاستقبال أن تقوم بصفة خاصة باحترام مبدأ عدم الإعادة بشكل قسري، الذي يعني عدم تعريض اللاجئين من جديد للمخاطر التي أفلتوا منها من خلال طردهم أو اقتيادهم إلى الحدود، مما هو وارد في الإعلان المتعلق باللجوء الإقليمي.

In addition to persons facing persecution, the Declaration on Territorial Asylum states that persons " struggling against colonialism " are among those who may be granted Territorial Asylum.

Article 9 of the Decree of 23 June 1998 on Territorial Asylum provides, in the event of a threat to public order, for an emergency procedure which may result in the applicant being denied temporary residence.
وتنص المادة 9 من مرسوم 23 حزيران/يونيه 1998 المتعلق باللجوء الإقليمي في حالة تهديد النظام العام على إجراءات استعجالية من نتائجها عدم منح حق اللجوء المؤقت لطالب اللجوء.

The Convention on Territorial Asylum, concluded at Caracas on 28 March 1954, specifies the causes of persecution that may give victims a right to Territorial Asylum.
فالاتفاقية المتعلقة باللجوء الإقليمي الموقعة بكاراكاس في 28 آذار/مارس 1954() تحدد أسباب الاضطهاد التي تبرر حصول ضحاياها على حق اللجوء الإقليمي.

110. The right of a State to decide whether or not to admit an alien is also recognized in general terms in article I of the Convention on Territorial Asylum: " Every State has the right, in the exercise of its sovereignty, to admit into its territory such persons as it deems advisable, without, through the exercise of this right, giving rise to complaint by any other State. "
110 - وحق الدولة في أن تقرر السماح بدخول أجنبي إلى إقليمها من عدمه هو حق معترف به أيضا بعبارات عامة في المادة الأولى من اتفاقية منظمة الدول الأمريكية المتعلقة باللجوء الإقليمي التي تنص على ما يلي: " لكل دولة الحق، في إطار ممارستها لسيادتها، في أن تسمح بدخول أشخاص إلى إقليمها وفقما تراه مستصوبا، من دون أن يثير ذلك، من خلال ممارسة هذا الحق، شكوى من أي دولة أخرى() " .
